protecti<strong>on</strong> of children from sexual exploitati<strong>on</strong> and sexual abuse through the enforcement of crim<strong>in</strong>al<br />

law, the C<strong>on</strong>venti<strong>on</strong> takes <strong>in</strong>to c<strong>on</strong>siderati<strong>on</strong> the progressive digitalisati<strong>on</strong> of society and the development<br />

of technology. The express aim of the C<strong>on</strong>venti<strong>on</strong> is to protect children from the negative effects<br />

of such technologies, such as new forms of abuse that can occur <strong>in</strong> the digital world. 3 By virtue of this<br />

C<strong>on</strong>venti<strong>on</strong>, it is clear that an <strong>in</strong>tegrated approach to tackl<strong>in</strong>g sexual violence aga<strong>in</strong>st children – <strong>on</strong>e<br />

which <strong>in</strong>cludes the digital aspects – is what is required.<br />

The Landelijke Expertgroep Digikids [Digikids <str<strong>on</strong>g>Nati<strong>on</strong>al</str<strong>on</strong>g> Expert Group] of the Dutch police provides a<br />

role for the juvenile police <strong>in</strong> cyberspace, and applies three pre-c<strong>on</strong>diti<strong>on</strong>s <strong>in</strong> this regard, namely<br />

police awareness and communicati<strong>on</strong> towards young people (digital awareness), <strong>on</strong>l<strong>in</strong>e availability<br />

of the police <strong>in</strong> order to carry out its core duties (digital accessibility) and the competence of the<br />

police to actually be able to carry out these duties (digital competence). 4 Other organisati<strong>on</strong>s <strong>in</strong><br />

sectors such as youth care services could also apply these pre-c<strong>on</strong>diti<strong>on</strong>s relat<strong>in</strong>g to the digital<br />

world <strong>in</strong> their c<strong>on</strong>tact with children. 5<br />

The present chapter will describe the implementati<strong>on</strong> of the strategy to tackle child pornography, viewed<br />

partly <strong>in</strong> the broader c<strong>on</strong>text of protect<strong>in</strong>g children from sexual violence. As far as the implementati<strong>on</strong><br />

itself is c<strong>on</strong>cerned, it is possible to dist<strong>in</strong>guish between a number of processes, which will be described<br />

below. The order <strong>in</strong> which these processes will be described corresp<strong>on</strong>ds with the f<strong>in</strong>d<strong>in</strong>gs from Chapter<br />

1. It is, after all, <strong>in</strong> Chapter 1 that the various stages of becom<strong>in</strong>g a perpetrator or victim, and the modus<br />

operandi to produce and obta<strong>in</strong> material, are discussed. The processes that form part of the strategy to<br />

tackle child pornography can be identified <strong>in</strong> each stage of becom<strong>in</strong>g a perpetrator or victim. For example,<br />

primary and sec<strong>on</strong>dary preventi<strong>on</strong> projects focus up<strong>on</strong> prevent<strong>in</strong>g <strong>in</strong>dividuals from becom<strong>in</strong>g<br />

perpetrators or victims, and prevent<strong>in</strong>g material from be<strong>in</strong>g produced, even before crim<strong>in</strong>al acts have<br />

been committed (§3.2). Whenever (preparatory) activities are identified, any acts by perpetrators, victimisati<strong>on</strong><br />

of children, and related material must be reported to the relevant authorities (§3.3). We will then<br />

go <strong>on</strong> to describe the repressive approach: detecti<strong>on</strong> (§3.4), prosecuti<strong>on</strong> and trial (§3.5), and after-care<br />

for and m<strong>on</strong>itor<strong>in</strong>g of perpetrators, and focus up<strong>on</strong> the c<strong>on</strong>victed sex offenders §3.6). After-care and<br />

m<strong>on</strong>itor<strong>in</strong>g are not <strong>on</strong>ly <strong>in</strong> place to serve the perpetrator him/herself, but also aim to uphold the safety<br />

of society and to prevent others from becom<strong>in</strong>g victims. The aspects relat<strong>in</strong>g to child pornography are<br />

expla<strong>in</strong>ed <strong>in</strong> the most detail <strong>in</strong> the secti<strong>on</strong>s <strong>in</strong> which we describe the repressive process. This comes as no<br />

surprise, as the acti<strong>on</strong> taken by the police, the Public Prosecuti<strong>on</strong> Service, the judiciary and (<strong>in</strong> part) the<br />

probati<strong>on</strong> and after-care service is per def<strong>in</strong>iti<strong>on</strong> based up<strong>on</strong> Article 240b of the Dutch Crim<strong>in</strong>al Code. In<br />

§3.7 we will discuss the support provided to victims. This process <strong>in</strong>volves provid<strong>in</strong>g care for victims of<br />

child pornography. This c<strong>on</strong>sists of support for m<strong>in</strong>ors experienc<strong>in</strong>g the c<strong>on</strong>sequences of sexual abuse<br />

and of the forms of <strong>on</strong>l<strong>in</strong>e sexual violence, <strong>in</strong>clud<strong>in</strong>g the distributi<strong>on</strong>, possessi<strong>on</strong> and view<strong>in</strong>g of images<br />

<strong>in</strong> which they feature.<br />
