3.5.4 Prosecuti<strong>on</strong> and trial <strong>in</strong> figures<br />
A large “dark number” of <strong>in</strong>stances of child pornography exist. This means that the number of child<br />
pornography cases known to the police does not represent the total number of <strong>in</strong>stances of child pornography<br />
<strong>in</strong> society. Depend<strong>in</strong>g up<strong>on</strong> the available capacity and up<strong>on</strong> <strong>in</strong>dicati<strong>on</strong>s that <strong>in</strong>crease the<br />
likelihood of detecti<strong>on</strong>, am<strong>on</strong>gst other th<strong>in</strong>gs, a certa<strong>in</strong> number of the child pornography cases known<br />
to the police are successfully c<strong>on</strong>cluded and forwarded to the Public Prosecuti<strong>on</strong> Service. This secti<strong>on</strong><br />
c<strong>on</strong>ta<strong>in</strong>s statistical <strong>in</strong>formati<strong>on</strong> regard<strong>in</strong>g the cases of child pornography that are registered with the<br />
Public Prosecuti<strong>on</strong> Service and the child pornography cases that are settled <strong>in</strong> first <strong>in</strong>stance or <strong>on</strong> appeal.<br />
This c<strong>on</strong>cerns:<br />
– Informati<strong>on</strong> orig<strong>in</strong>at<strong>in</strong>g from the Public Prosecuti<strong>on</strong> Service <strong>in</strong> §3.5.4.1 (regard<strong>in</strong>g the prosecuti<strong>on</strong><br />
of suspects), §3.5.4.2 (regard<strong>in</strong>g the trial of suspects <strong>in</strong> first <strong>in</strong>stance) and <strong>in</strong> §3.5.4.4 (regard<strong>in</strong>g background<br />
characteristics of suspects and <strong>in</strong>dividuals sentenced <strong>in</strong> first <strong>in</strong>stance).<br />
– Informati<strong>on</strong> orig<strong>in</strong>at<strong>in</strong>g from the Investigati<strong>on</strong> and Policy Database of Judicial Documentati<strong>on</strong> <strong>in</strong><br />
§3.5.4.3 (regard<strong>in</strong>g the trial of suspects <strong>on</strong> appeal).<br />
The different items of data <strong>in</strong> this secti<strong>on</strong> do not represent a cohort. After all, not all cases registered with<br />
the Public Prosecuti<strong>on</strong> Service are c<strong>on</strong>cluded by the Public Prosecuti<strong>on</strong> Service <strong>in</strong> the same year <strong>in</strong> which<br />
they are registered, or settled <strong>in</strong> first <strong>in</strong>stance or <strong>on</strong> appeal. It should also be noted that the formulati<strong>on</strong><br />
of the secti<strong>on</strong> of the law c<strong>on</strong>cern<strong>in</strong>g child pornography does not, unfortunately, make it possible to<br />
differentiate, <strong>on</strong> the basis of subsecti<strong>on</strong>s, between the possessi<strong>on</strong>, distributi<strong>on</strong> and producti<strong>on</strong> of child<br />
abuse material. The statistics that orig<strong>in</strong>ate from the Public Prosecuti<strong>on</strong> Service and the Investigati<strong>on</strong><br />
and Policy Database of Judicial Documentati<strong>on</strong> do not therefore provide <strong>in</strong>formati<strong>on</strong> about this dist<strong>in</strong>cti<strong>on</strong>,<br />
which is a very relevant <strong>on</strong>e. 433<br />
3.5.4.1 Prosecuti<strong>on</strong> <strong>in</strong> figures<br />
Number of child pornography cases registered with the Public Prosecuti<strong>on</strong> Service<br />
Figure 3.7 shows the trend with regard to the annual number of child pornography cases registered<br />
with the Public Prosecuti<strong>on</strong> Service aga<strong>in</strong>st <strong>in</strong>dividual suspects <strong>in</strong> the period between 2005 and<br />
2010. 434 The term ‘child pornography cases’ refers to cases <strong>in</strong> which child pornography def<strong>in</strong>itely<br />
plays a role. It is often the case that these cases also <strong>in</strong>volve other offences, <strong>in</strong> additi<strong>on</strong> to child<br />
pornography.<br />
