Exclusi<strong>on</strong> order by the mayor<br />

A municipality also has the opportunity to impose an exclusi<strong>on</strong> order <strong>on</strong> the basis of Article 172, paragraph<br />

3 of the Municipalities Act. This provisi<strong>on</strong> rules that the mayor has the authority, <strong>in</strong> the event of a<br />

breach of public order or serious c<strong>on</strong>cern with regard to the creati<strong>on</strong> of such a breach, to take measures<br />

that are necessary to ma<strong>in</strong>ta<strong>in</strong> the public order. An exclusi<strong>on</strong> order can also be imposed <strong>on</strong> the basis<br />

of the corresp<strong>on</strong>d<strong>in</strong>g general municipal by-law. This enables a mayor to prohibit some<strong>on</strong>e from tak<strong>in</strong>g<br />

up residence <strong>in</strong> a particular place. In order to impose an exclusi<strong>on</strong> order, a number of c<strong>on</strong>diti<strong>on</strong>s must<br />

be complied with. The exclusi<strong>on</strong> order may <strong>on</strong>ly be imposed <strong>in</strong> the event that the circumstances (disturbance<br />

of public order) so require. The order must also be <strong>in</strong>tended to end the disturbance of public<br />

order or to limit the c<strong>on</strong>sequences of this disturbance. What is more, the term of the exclusi<strong>on</strong> order<br />

must be associated with the durati<strong>on</strong> of the disturbance of public order. The term of the order may not<br />

be disproporti<strong>on</strong>ately l<strong>on</strong>g. 551 With regard to the exclusi<strong>on</strong> order <strong>on</strong> the basis of Article 172, paragraph 3<br />

of the Municipalities Act, a maximum of three m<strong>on</strong>ths seems to be applied. In the event that orders that<br />

limit freedom are set aside by the court, <strong>in</strong>clud<strong>in</strong>g exclusi<strong>on</strong> orders, this tends to be due to previouslystated<br />

c<strong>on</strong>diti<strong>on</strong>s not be<strong>in</strong>g taken <strong>in</strong>to c<strong>on</strong>siderati<strong>on</strong>. Accord<strong>in</strong>g to the M<strong>in</strong>ister of the Interior and<br />

K<strong>in</strong>gdom Relati<strong>on</strong>s, the problem was not due to the possibilities that exist under the law, but to how<br />

these powers were applied. 552 It is not always the case that it is the <strong>in</strong>dividual who is return<strong>in</strong>g to society<br />

who is resp<strong>on</strong>sible for disturb<strong>in</strong>g public order through his/her own behaviour. The resp<strong>on</strong>se that is anticipated<br />

from the neighbourhood <strong>in</strong> relati<strong>on</strong> to his/her presence can also give cause to take acti<strong>on</strong>. 553<br />

In order to be able to take adequate steps if this is necessary, a mayor must, however, have access to<br />

relevant <strong>in</strong>formati<strong>on</strong> (see §3.6.3.2 below). On the basis of the <strong>in</strong>formati<strong>on</strong> that is available, the mayor<br />

must then make an assessment.<br />

The mayor of E<strong>in</strong>dhoven banned a c<strong>on</strong>victed sex offender (van der V.) from liv<strong>in</strong>g <strong>in</strong> E<strong>in</strong>dhoven.<br />

On the basis of this decisi<strong>on</strong>, Van der V. raised an objecti<strong>on</strong> and ultimately lodged an appeal at<br />

the adm<strong>in</strong>istrative tribunal. The adm<strong>in</strong>istrative tribunal decided <strong>in</strong> his favour and judged that the<br />

exclusi<strong>on</strong> order imposed by the mayor c<strong>on</strong>stituted a disproporti<strong>on</strong>ate <strong>in</strong>fr<strong>in</strong>gement of his freedom<br />

order, the statutory regulati<strong>on</strong>s may not be deviated from unless it appears from the competence<br />

that space has been left for this – Article 172, paragraph 3 of the Municipalities Act does not provide<br />

such space. In future, impos<strong>in</strong>g the measure must comply with the requirements of subsidiarity and<br />

proporti<strong>on</strong>ality.<br />
