of the event. 7 S<strong>in</strong>ce that time, children have (also) been sexually abused for the purpose of produc<strong>in</strong>g<br />
child abuse material. 8 S<strong>in</strong>ce the 1960s, the producti<strong>on</strong>, distributi<strong>on</strong> and view<strong>in</strong>g of such material have<br />
<strong>in</strong>creased significantly, and the first studies of the phenomen<strong>on</strong> were carried out some time later. 9 We<br />
can see parallels between this pre-Internet period and the present digital age. Even at that time, <strong>in</strong>dividuals<br />
with a sexual preference for children were <strong>in</strong> c<strong>on</strong>tact with other perpetrators and (potential) victims<br />
all over the world. At that time, people also attempted to c<strong>on</strong>ceal their communicati<strong>on</strong>s, as is the case<br />
now, <strong>in</strong> order to avoid be<strong>in</strong>g discovered.<br />
The late 1960s to the mid-1980s<br />
Dur<strong>in</strong>g the 1960s a more liberal sexual morality developed, which emerged partly as a result of the secularisati<strong>on</strong><br />
of society, the development of means of c<strong>on</strong>tracepti<strong>on</strong> and the <strong>in</strong>crease <strong>in</strong> levels of educati<strong>on</strong>.<br />
This decade saw the emergence of movements that proclaimed the pr<strong>in</strong>ciple of “free love”, <strong>in</strong>clud<strong>in</strong>g sex<br />
with m<strong>in</strong>ors. 10 On the <strong>on</strong>e hand, the producti<strong>on</strong> and distributi<strong>on</strong> of child abuse images <strong>in</strong> those years<br />
was the result of the spirit of the age, but it was also made possible due to the fact that technologies<br />
for film and photography were becom<strong>in</strong>g <strong>in</strong>creas<strong>in</strong>gly accessible to the public at large. Although the<br />
quality was still poor, practically any<strong>on</strong>e could produce child abuse material and view it at home. There<br />
were no efforts to tackle child pornography dur<strong>in</strong>g the 1960s and 1970s; legislati<strong>on</strong> to that end was not<br />
<strong>in</strong> place until the mid-1980s.<br />
Developments <strong>in</strong> legislative history<br />
Article 240b of the Dutch Crim<strong>in</strong>al Code, <strong>in</strong> which various acts relat<strong>in</strong>g to child pornography were<br />
made <strong>in</strong>to crim<strong>in</strong>al offences, entered <strong>in</strong>to force <strong>in</strong> 1986. 11 Prior to that time, crim<strong>in</strong>al legislati<strong>on</strong><br />
<strong>in</strong> the Netherlands did not c<strong>on</strong>ta<strong>in</strong> any separate provisi<strong>on</strong>s that crim<strong>in</strong>alised acts relat<strong>in</strong>g to child<br />
pornography. Initially, it was not deemed necessary either. For example, <strong>in</strong> the early 1980s, the<br />
government stated, with<strong>in</strong> the c<strong>on</strong>text of the policy to tackle sexual violence aga<strong>in</strong>st women and<br />
girls, that various provisi<strong>on</strong>s <strong>in</strong> the Dutch Crim<strong>in</strong>al Code already ensured that acti<strong>on</strong> could be taken<br />
<strong>in</strong> situati<strong>on</strong>s <strong>in</strong> which there was evidence of threat, coerci<strong>on</strong> or actual physical violence aga<strong>in</strong>st<br />
women who worked (or <strong>in</strong>tended to work) as models. Accord<strong>in</strong>g to the government, the same<br />
argument held true for those forms of pornography <strong>in</strong> which m<strong>in</strong>ors were used as models. Articles<br />
244 et seq. were deemed to provide sufficient means of tak<strong>in</strong>g acti<strong>on</strong> aga<strong>in</strong>st such offences. 12 It was<br />
therefore possible to take acti<strong>on</strong> aga<strong>in</strong>st child abuse images, but prior to 1986 it was <strong>on</strong>ly possible<br />
<strong>on</strong> the grounds of the fact that the distributi<strong>on</strong> of child abuse material c<strong>on</strong>stituted an offence, and<br />
