In additi<strong>on</strong>, the crim<strong>in</strong>alisati<strong>on</strong> of simple possessi<strong>on</strong> of child abuse material was also taken a step<br />
further; until that time, possessi<strong>on</strong> was not a crim<strong>in</strong>al offence. To c<strong>on</strong>stitute a crim<strong>in</strong>al offence,<br />
it is now no l<strong>on</strong>ger a requirement for certa<strong>in</strong> acts, <strong>in</strong>clud<strong>in</strong>g ‘hav<strong>in</strong>g possessi<strong>on</strong> [with an <strong>in</strong>tent to<br />
distribute or display],’ to take place with a view to distribut<strong>in</strong>g or openly exhibit<strong>in</strong>g child abuse<br />
material; rather, the legislator now regards such acts as a punishable offence, even if there was<br />
no additi<strong>on</strong>al <strong>in</strong>tenti<strong>on</strong> <strong>in</strong>volved. Furthermore, this also does away with the need to provide evidence<br />
of such <strong>in</strong>tent. 47 The producti<strong>on</strong> of child abuse material for pers<strong>on</strong>al use and possessi<strong>on</strong><br />
of such material <strong>in</strong> the private doma<strong>in</strong> are now also subject to the provisi<strong>on</strong>s of Article 240b of<br />
the Dutch Crim<strong>in</strong>al Code.<br />
Further legislative changes followed <strong>in</strong> 2002, 48 chiefly by reas<strong>on</strong> of <strong>in</strong>ternati<strong>on</strong>al developments.<br />
The ratificati<strong>on</strong> by the Netherlands of the ILO C<strong>on</strong>venti<strong>on</strong> C<strong>on</strong>cern<strong>in</strong>g the Prohibiti<strong>on</strong> and Immediate<br />
Acti<strong>on</strong> for the Elim<strong>in</strong>ati<strong>on</strong> of the Worst Forms of <str<strong>on</strong>g>Child</str<strong>on</strong>g> Labour, <strong>in</strong> 1999 49 made it mandatory<br />
to raise the age limit <strong>in</strong> Article 240b of the Dutch Crim<strong>in</strong>al Code to 18 years. In additi<strong>on</strong>, due to<br />
the ratificati<strong>on</strong> of the C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> Cybercrime created with<strong>in</strong> the framework of the Council<br />
of Europe, 50 virtual child abuse material also became a crim<strong>in</strong>al offence. The words ‘schijnbaar<br />
betrokken’ [apparently <strong>in</strong>volved] were added to Article 240b of the Dutch Crim<strong>in</strong>al Code, which<br />
means that it is no l<strong>on</strong>ger a requisite that a real child was <strong>in</strong>volved <strong>in</strong> the producti<strong>on</strong> of child<br />
abuse material. The term<strong>in</strong>ology ‘<strong>in</strong> voorraad hebben’ [hav<strong>in</strong>g possessi<strong>on</strong> (with an <strong>in</strong>tent to distribute<br />
or display)] was replaced by the word ‘bezit’ [possessi<strong>on</strong>] follow<strong>in</strong>g a rul<strong>in</strong>g by the Supreme<br />
Court. 51 The possessi<strong>on</strong> of a child abuse image also <strong>in</strong>cludes the possessi<strong>on</strong> of <strong>on</strong>e or more images<br />
for pers<strong>on</strong>al use, so the possessi<strong>on</strong> of <strong>on</strong>e or more images for pers<strong>on</strong>al use also c<strong>on</strong>stitutes<br />
a crim<strong>in</strong>al offence. From that po<strong>in</strong>t <strong>on</strong>wards, and as is still the case now, the provisi<strong>on</strong>s mak<strong>in</strong>g<br />
child pornography a crim<strong>in</strong>al offence c<strong>on</strong>cern three types of child abuse material: 1. an image of<br />
a real child (any pers<strong>on</strong> below the age of 18 years); 2. an image of a real pers<strong>on</strong> who looks like a<br />
child; 3. a realistic image of a n<strong>on</strong>-existent child. 52 These amendments form part of the partial<br />
amendment to the decency legislati<strong>on</strong> and therefore also relate to crim<strong>in</strong>al provisi<strong>on</strong>s other<br />
