Dutch Domestic Violence and <str<strong>on</strong>g>Child</str<strong>on</strong>g> Abuse Report<strong>in</strong>g Code (Compulsory Use) Act<br />

A legislative proposal 157 is currently under c<strong>on</strong>siderati<strong>on</strong> <strong>in</strong> which professi<strong>on</strong>als work<strong>in</strong>g <strong>in</strong> the sectors<br />

c<strong>on</strong>cerned with healthcare, care for the elderly, care for the disabled, youth care, social support,<br />

educati<strong>on</strong>, and childcare, as well as <strong>in</strong> the judicial sector, are required to work <strong>in</strong> accordance with a<br />

report<strong>in</strong>g code whenever they encounter <strong>in</strong>dicators of domestic violence or child abuse (<strong>in</strong>clud<strong>in</strong>g<br />

sexual violence) <strong>in</strong> the course of their work. 158 The report<strong>in</strong>g code c<strong>on</strong>sists of a step-by-step plan<br />

that outl<strong>in</strong>es the best course of acti<strong>on</strong> for a professi<strong>on</strong>al <strong>in</strong> the event that he/she suspects domestic<br />

violence or child abuse. In the basic model of the domestic violence and child abuse report<strong>in</strong>g<br />

code, the sec<strong>on</strong>d step <strong>in</strong>volves c<strong>on</strong>sultati<strong>on</strong> with colleagues and c<strong>on</strong>sult<strong>in</strong>g the AMK if m<strong>in</strong>ors are<br />

c<strong>on</strong>cerned. Ultimately, if the professi<strong>on</strong>al him/herself is unable to provide sufficient protecti<strong>on</strong>,<br />

he/she should report the m<strong>in</strong>or to the AMK. 159 This compulsory report<strong>in</strong>g code therefore does<br />

not make it mandatory for professi<strong>on</strong>als to report issues. Professi<strong>on</strong>als are not required to report<br />

<strong>in</strong>dicators to an AMK but they are required to follow a step-by-step plan, as part of which they are<br />

able to assess themselves whether it is necessary to report the issue to the AMK. Professi<strong>on</strong>als<br />

who are normally bound by professi<strong>on</strong>al c<strong>on</strong>fidentiality (such as paediatricians/doctors etc.) are<br />

entitled to report their observati<strong>on</strong>s however, 160 which enables doctors to supply <strong>in</strong>formati<strong>on</strong> to<br />

the Youth Care Agency (particularly the AMK) without the c<strong>on</strong>sent of the <strong>in</strong>dividual c<strong>on</strong>cerned “if<br />

this can be c<strong>on</strong>sidered necessary <strong>in</strong> order to put an end to a child abuse situati<strong>on</strong> or to <strong>in</strong>vestigate a reas<strong>on</strong>able<br />

suspici<strong>on</strong> of child abuse”. 161<br />

If a professi<strong>on</strong>al suspects that child abuse, <strong>in</strong>clud<strong>in</strong>g sexual violence, has taken place, he/she must also<br />

c<strong>on</strong>sider whether to file a report <strong>in</strong> the reference <strong>in</strong>dex of young people at risk (VIR), as well as act<strong>in</strong>g <strong>in</strong><br />

accordance with a report<strong>in</strong>g code or protocol. By register<strong>in</strong>g a child <strong>in</strong> the VIR, different <strong>in</strong>dicators can<br />

be gathered <strong>in</strong> <strong>on</strong>e place and follow-up acti<strong>on</strong>s can be coord<strong>in</strong>ated. Registrati<strong>on</strong> <strong>in</strong> the VIR therefore<br />

forms part of the Basic model of the domestic violence and child abuse report<strong>in</strong>g code, and the Gunn<strong>in</strong>g<br />

Committee has also recommended that it should be used more often. 162<br />
