the other hand, 114 it is clear that the provisi<strong>on</strong>s mak<strong>in</strong>g producti<strong>on</strong> an offence are based up<strong>on</strong> the fact<br />
that producti<strong>on</strong> <strong>in</strong>volves sexual acts that could harm the child, either because <strong>in</strong>volv<strong>in</strong>g the child <strong>in</strong><br />
such behaviour is, <strong>in</strong> itself, harmful, or is harmful due to the publicati<strong>on</strong> of the material c<strong>on</strong>cerned. 115<br />
The fact that child pornography <strong>in</strong> itself c<strong>on</strong>stitutes sexual abuse of children is also recognised <strong>in</strong>ternati<strong>on</strong>ally.<br />
116 The producti<strong>on</strong> of child abuse material can exacerbate the (sexual) violence, 117 s<strong>in</strong>ce the<br />
images emphasise the powerlessness and humiliati<strong>on</strong> of the victim. In additi<strong>on</strong>, <strong>in</strong> those cases that<br />
<strong>in</strong>volve abuse, the abuse may <strong>in</strong>crease <strong>in</strong> durati<strong>on</strong> and severity due to the fact that the child is made<br />
to perform acts <strong>in</strong> fr<strong>on</strong>t of the camera. In the literature, the <strong>in</strong>tenti<strong>on</strong>al view<strong>in</strong>g and distributi<strong>on</strong> of<br />
the material are regarded as c<strong>on</strong>stitut<strong>in</strong>g punishable offences due to the fact that a child is abused (by<br />
the publicati<strong>on</strong> of the material). 118 Victims of child pornography experience harmful c<strong>on</strong>sequences<br />
due to the permanent circulati<strong>on</strong> of images <strong>on</strong> the Internet. 119 In additi<strong>on</strong>, the legislator argues that<br />
children must be protected from behaviour or manifestati<strong>on</strong>s that c<strong>on</strong>tribute towards a sub-culture<br />
that promotes sexual abuse of children. 120 This view closely reflects the functi<strong>on</strong>s that child abuse material<br />
can fulfil as far as users are c<strong>on</strong>cerned (described <strong>in</strong> 1.4.1.3): it is used, am<strong>on</strong>gst other purposes,<br />
to corrupt and blackmail children and to normalise a sexual <strong>in</strong>terest <strong>in</strong> children am<strong>on</strong>gst adults. 121<br />
Further to this, the Implementati<strong>on</strong> Provisi<strong>on</strong>s c<strong>on</strong>cern<strong>in</strong>g child pornography [Aanwijz<strong>in</strong>g k<strong>in</strong>derpornografie]<br />
also assume that both the child who is directly <strong>in</strong>volved <strong>in</strong> the producti<strong>on</strong> of child abuse<br />
material and the child <strong>in</strong> general must be protected. That applies to children <strong>in</strong> the Netherlands as<br />
well as children elsewhere. 122<br />
<str<strong>on</strong>g>Child</str<strong>on</strong>g> abuse<br />
The phenomen<strong>on</strong> of child pornography and the strategy to tackle it must be viewed and approached<br />
<strong>in</strong> a broad c<strong>on</strong>text, s<strong>in</strong>ce whenever child abuse material is found, it usually means that child abuse has<br />
taken place. <str<strong>on</strong>g>Child</str<strong>on</strong>g> abuse is all the acti<strong>on</strong>s of parents, or of other <strong>in</strong>dividuals with whom a child has a<br />
relati<strong>on</strong>ship of dependency, that c<strong>on</strong>stitute a severe harmful effect up<strong>on</strong> the child or a threat to the safety<br />
or welfare of the child. 123 <str<strong>on</strong>g>Child</str<strong>on</strong>g> abuse may take the form of sexual abuse.<br />
