terial of category 3 and upwards is deemed to c<strong>on</strong>stitute a crim<strong>in</strong>al offence. 180 The classificati<strong>on</strong> also<br />
dem<strong>on</strong>strates the c<strong>on</strong>siderable variati<strong>on</strong> <strong>in</strong> sexual themes. Producti<strong>on</strong> and users’ collecti<strong>on</strong>s can also be<br />
classified <strong>in</strong>to a narrative order (series). 181 Examples of this might be images <strong>in</strong> which children remove<br />
their clothes and/or gradually work towards specific sexual c<strong>on</strong>duct.<br />
1) (Indicative) N<strong>on</strong>-erotic and n<strong>on</strong>-sexualised images show<strong>in</strong>g m<strong>in</strong>ors <strong>in</strong> their underwear, swimm<strong>in</strong>g<br />
costumes, etc., from commercial leaflets or family envir<strong>on</strong>ments, for example.<br />
2) (Nudist) Images of naked or semi-naked m<strong>in</strong>ors <strong>in</strong> ord<strong>in</strong>ary nudist sett<strong>in</strong>gs and from legitimate<br />
sources.<br />
3) (Erotica) Photographs of m<strong>in</strong>ors (play<strong>in</strong>g) <strong>in</strong> an ord<strong>in</strong>ary envir<strong>on</strong>ment, taken surreptitiously<br />
and/or obviously <strong>on</strong> the basis of a sexual <strong>in</strong>terest <strong>in</strong> m<strong>in</strong>ors, <strong>in</strong> which either the underwear<br />
forms the express subject of the image or the m<strong>in</strong>or is fully or entirely unclothed and the nudity<br />
or the m<strong>in</strong>or’s genitals (whether or not covered) form the focus of the image.<br />
4) (Erotic pos<strong>in</strong>g) Deliberately posed pictures of m<strong>in</strong>ors fully or partially clothed or naked, <strong>in</strong> sexualised<br />
or sexually provocative poses or circumstances, <strong>in</strong> which the emphasis is placed up<strong>on</strong> the<br />
nudity or the m<strong>in</strong>or’s genitals (whether or not covered).<br />
5) (Explicit sexual activity) Images of m<strong>in</strong>ors fully or partially clothed or naked, <strong>in</strong>volv<strong>in</strong>g the<br />
follow<strong>in</strong>g:<br />
- M<strong>in</strong>ors touch<strong>in</strong>g their own genitals or those of other m<strong>in</strong>ors, masturbat<strong>in</strong>g or <strong>in</strong>volved <strong>in</strong><br />
sexual <strong>in</strong>tercourse with <strong>on</strong>e another.<br />
- M<strong>in</strong>ors be<strong>in</strong>g subject to assault, physical sexual penetrati<strong>on</strong>, masturbati<strong>on</strong>, or oral sex acts<br />
<strong>in</strong> which an adult is <strong>in</strong>volved, also <strong>in</strong>clud<strong>in</strong>g cases <strong>in</strong> which the m<strong>in</strong>or performs such acts<br />
up<strong>on</strong> an adult.<br />
- An animal is <strong>in</strong>volved <strong>in</strong> a form of sexual c<strong>on</strong>duct with or by a m<strong>in</strong>or.<br />
The material <strong>in</strong> the aforementi<strong>on</strong>ed categories <strong>on</strong>e (<strong>in</strong>dicative material) and two (nudist material) do<br />
not c<strong>on</strong>stitute crim<strong>in</strong>al offences. However, such images and many other types of material serve a sexual<br />
functi<strong>on</strong> <strong>in</strong> relati<strong>on</strong> to children <strong>in</strong> the case of some <strong>in</strong>dividuals. Examples of such material might <strong>in</strong>clude<br />
advertisements <strong>in</strong> newspapers, pa<strong>in</strong>t<strong>in</strong>gs, corresp<strong>on</strong>dence between perpetrators or between perpetrators<br />
and children, children’s toys and written accounts of sexual abuse of children. 182<br />
‘Apparent age’<br />
The objectified element of ‘apparent age’ implies <strong>on</strong> the <strong>on</strong>e hand that the suspect’s <strong>in</strong>tenti<strong>on</strong> does not<br />
have to be directed towards age. A suspect is unable to argue that he/she was unaware that the <strong>in</strong>dividual<br />
<strong>on</strong> the image was a m<strong>in</strong>or. Furthermore, this formulati<strong>on</strong> means that the Public Prosecuti<strong>on</strong> Service<br />
does not have to prove the age of the pers<strong>on</strong> depicted <strong>in</strong> order to ascerta<strong>in</strong> that the material c<strong>on</strong>cerns<br />
