whether the police take acti<strong>on</strong> <strong>on</strong> the grounds of Article 110 of the Dutch Code of Crim<strong>in</strong>al Procedure or<br />

Article 551 of the Dutch Code of Crim<strong>in</strong>al Procedure. 348<br />

All manner of <strong>in</strong>vestigati<strong>on</strong> activities may be employed <strong>in</strong> a search carried out pursuant to Article<br />

110 of the Dutch Code of Crim<strong>in</strong>al Procedure, for example tak<strong>in</strong>g photographs <strong>in</strong> the dwell<strong>in</strong>g. Thorough<br />

searches for <strong>in</strong>dicators may also be carried out to support the <strong>in</strong>vestigati<strong>on</strong>. This Article therefore<br />

offers more possibilities than Article 551 of the Dutch Code of Crim<strong>in</strong>al Procedure. However, it<br />

is sometimes difficult to obta<strong>in</strong> permissi<strong>on</strong> from the exam<strong>in</strong><strong>in</strong>g judge for a search <strong>on</strong> the grounds<br />

of Article 110 of the Dutch Code of Crim<strong>in</strong>al Procedure, particularly if it c<strong>on</strong>cerns older cases. In some<br />

regi<strong>on</strong>s, the means offered by Article 551 are therefore chosen. In that case, the ma<strong>in</strong> occupant is<br />

ordered to surrender the data storage medium. The ma<strong>in</strong> occupant must then be prepared to lend<br />

his/her cooperati<strong>on</strong> and comply with the demand. (Other) search activities are not possible <strong>in</strong> that<br />

case, however. If the suspect refuses to cooperate, the activities at the scene are halted and the<br />

exam<strong>in</strong><strong>in</strong>g judge may yet be called <strong>in</strong>. This situati<strong>on</strong> hardly ever occurs, accord<strong>in</strong>g to the regi<strong>on</strong>al<br />

police forces (such as Utrecht). 349 The advantages of <strong>in</strong>vok<strong>in</strong>g Article 551 of the Dutch Code of<br />

Crim<strong>in</strong>al Procedure are first of all that this opti<strong>on</strong> is less labour-<strong>in</strong>tensive and therefore places less<br />

of a burden up<strong>on</strong> capacity. Nevertheless, although the <strong>in</strong>vestigati<strong>on</strong> is less thorough, evidence can<br />

still be gathered, the victim’s identity can be searched for and <strong>in</strong>terventi<strong>on</strong>s can be taken <strong>in</strong> relati<strong>on</strong><br />

to the perpetrator. The experiences of the <strong>in</strong>vestigat<strong>in</strong>g officers <strong>in</strong>volved has taught us that <strong>in</strong> most<br />

cases, when faced with a demand pursuant to Article 551 of the Dutch Crim<strong>in</strong>al Code, suspects lend<br />

their cooperati<strong>on</strong> and also make a statement. 350 A possible disadvantage of acti<strong>on</strong> taken pursuant<br />

to Article 551 is that, particularly where a large team is <strong>in</strong>volved <strong>in</strong> the acti<strong>on</strong>, the degree to which<br />

the ma<strong>in</strong> occupant freely lends his/his cooperati<strong>on</strong> is open to questi<strong>on</strong>.<br />

Efficacy of detecti<strong>on</strong><br />

Dur<strong>in</strong>g the <strong>in</strong>vestigati<strong>on</strong>, the process of detecti<strong>on</strong> should focus <strong>on</strong> the identificati<strong>on</strong> of the victims and<br />

the perpetrators of sexual abuse, and the producti<strong>on</strong> of child abuse material. The extent to which these<br />

aims are achieved can be deduced from the number of victims that have been traced.<br />

The nati<strong>on</strong>al child pornography m<strong>on</strong>itor 2009 showed that the regi<strong>on</strong>al police forces processed 893 cases<br />

<strong>in</strong> 2008. A little more than 40 victims of sexual abuse and of the producti<strong>on</strong> of child abuse material were<br />

Code has been committed, there are two types of powers available to the police and the Public<br />

Prosecuti<strong>on</strong> Service that may result <strong>in</strong> the seizure of items such as data storage media. A search can<br />

be carried out <strong>in</strong> a dwell<strong>in</strong>g under the guidance of an exam<strong>in</strong><strong>in</strong>g judge pursuant to Article 110 of the<br />

Dutch Code of Crim<strong>in</strong>al Procedure (Article 97 can be <strong>in</strong>voked <strong>in</strong> urgent cases). In additi<strong>on</strong>, <strong>in</strong> the event<br />

of a crim<strong>in</strong>al offence as described <strong>in</strong> Article 240b of the Dutch Crim<strong>in</strong>al Code, Article 551 of the Dutch<br />

Code of Crim<strong>in</strong>al Procedure provides the officers stated <strong>in</strong> Article 141 of the Dutch Code of Crim<strong>in</strong>al<br />

Procedure with powers to demand the surrender of items for seizure and to proceed to seize all items<br />

capable of stor<strong>in</strong>g data (Implementati<strong>on</strong> of Provisi<strong>on</strong>s c<strong>on</strong>cern<strong>in</strong>g child pornography, paragraph 4.3).<br />

Many regi<strong>on</strong>al police forces <strong>in</strong>voke multiple legal grounds for seizure of items, whereby they act <strong>in</strong><br />

accordance with the case <strong>in</strong> questi<strong>on</strong>, as has been shown <strong>in</strong> the Korpsm<strong>on</strong>itor 2010, p.20.<br />
