C<strong>on</strong>clusi<strong>on</strong>s and recommendati<strong>on</strong>s<br />
The extent of the phenomen<strong>on</strong> of child pornography – perpetrators, victims and material – is unknown.<br />
As far as the number of perpetrators and the quantity of child abuse material are c<strong>on</strong>cerned, it may be<br />
argued that the extent of the problem is <strong>in</strong>creas<strong>in</strong>g. This means that we must seek a strategy to tackle<br />
child pornography both with<strong>in</strong> and bey<strong>on</strong>d the crim<strong>in</strong>al justice process. It is not known what proporti<strong>on</strong><br />
of m<strong>in</strong>or victims of sexual abuse are also victims of child pornography, nor can any judgments be<br />
made with regard to the numbers of m<strong>in</strong>ors who are victims of phenomena such as sext<strong>in</strong>g and c<strong>on</strong>tact<br />
made <strong>on</strong>l<strong>in</strong>e for a sexual purpose (groom<strong>in</strong>g). It is therefore necessary to <strong>in</strong>vestigate these areas <strong>in</strong> the<br />
Netherlands <strong>in</strong> order to develop and implement evidence-based policy.<br />
<str<strong>on</strong>g>Child</str<strong>on</strong>g> pornography is closely associated with other forms of sexual abuse or sexual violence aga<strong>in</strong>st children<br />
that is perpetrated <strong>in</strong> both the analogue and digital worlds. The legal framework has been useful <strong>in</strong><br />
def<strong>in</strong><strong>in</strong>g the area of <strong>in</strong>vestigati<strong>on</strong> – Article 240b of the Dutch Crim<strong>in</strong>al Code def<strong>in</strong>es child pornography<br />
itself – but it is not the <strong>on</strong>ly perspective that can be used to address the subject. The actual problem<br />
<strong>in</strong>volves protect<strong>in</strong>g children from sexual violence. In order to achieve this, however, an effective understand<strong>in</strong>g<br />
of the phenomen<strong>on</strong> is <strong>in</strong>dispensible.<br />
4.2.2 The government agenda<br />
For the purpose of this report, the policy resp<strong>on</strong>ses of the government to the development of the phenomen<strong>on</strong><br />
of child pornography have been <strong>in</strong>vestigated. Attenti<strong>on</strong> has been devoted to policies that<br />
are explicitly directed towards child pornography, but also to programmes that are directed towards<br />
child abuse <strong>in</strong> more general terms, <strong>in</strong>clud<strong>in</strong>g sexual violence aga<strong>in</strong>st children, as well as the various<br />
programmes <strong>in</strong> the field of domestic violence. Sexual violence aga<strong>in</strong>st children also forms a part of<br />
this issue. The extent to which the programmes menti<strong>on</strong>ed are, or could be, of <strong>in</strong>direct importance<br />
<strong>in</strong> tackl<strong>in</strong>g child pornography has also been c<strong>on</strong>sidered. From this po<strong>in</strong>t of reference, it appears that<br />
the policy <strong>on</strong>ly partially reflects the development, complexity and c<strong>on</strong>text of the phenomen<strong>on</strong> of child<br />
pornography.<br />
Current policy has been exam<strong>in</strong>ed, but the way <strong>in</strong> which the governmental policy has developed over<br />
the past decades and the extent to which less<strong>on</strong>s can be learnt from prior policies have also been analysed.<br />
What is strik<strong>in</strong>g is that with regard to child pornography, a major focus has been placed up<strong>on</strong> an<br />
<strong>in</strong>cident-driven policy. The <strong>on</strong>ly <strong>in</strong>tegrated programme to address the sexual abuse of children, <strong>in</strong> which<br />
child abuse material formed a comp<strong>on</strong>ent, was the <str<strong>on</strong>g>Nati<strong>on</strong>al</str<strong>on</strong>g> Acti<strong>on</strong> Plan for Combat<strong>in</strong>g Sexual Abuse<br />
of <str<strong>on</strong>g>Child</str<strong>on</strong>g>ren (NAPS). The NAPS ended <strong>in</strong> December 2002. After 2002, the framework for cooperati<strong>on</strong> that<br />
was created through the NAPS was no l<strong>on</strong>ger ma<strong>in</strong>ta<strong>in</strong>ed, <strong>in</strong> the sense that child pornography was no<br />
l<strong>on</strong>ger <strong>in</strong>tegrated <strong>in</strong>to a programme aimed at combat<strong>in</strong>g sexual violence aga<strong>in</strong>st children. C<strong>on</strong>t<strong>in</strong>uity<br />
with regard to this comp<strong>on</strong>ent was therefore absent. The <strong>in</strong>tenti<strong>on</strong> of the NAPS was to <strong>in</strong>tegrate the<br />
measures for tackl<strong>in</strong>g child pornography, but as a result of the NAPS ceas<strong>in</strong>g to exist, it seems as if the<br />
digital and analogue strands of the policy have come apart. With<strong>in</strong> the policy, child pornography tends to<br />
be branded as cybercrime and is therefore merely to be dealt with by the judicial authorities. The M<strong>in</strong>ister<br />
for Youth and Families emphasised this <strong>in</strong> resp<strong>on</strong>se to Parliamentary questi<strong>on</strong>s from Member of Parliament<br />
Verd<strong>on</strong>k, 1 with the remark that this topic primarily falls with<strong>in</strong> the remit of the M<strong>in</strong>istry of Justice. 2<br />
