the open Internet, where companies probably go without specific knowledge <strong>in</strong> the area of the sexual<br />

abuse comp<strong>on</strong>ent of child pornography.<br />

Prospect of removal<br />

The current work<strong>in</strong>g methods of the Hotl<strong>in</strong>e Combat<strong>in</strong>g <str<strong>on</strong>g>Child</str<strong>on</strong>g> <str<strong>on</strong>g>Pornography</str<strong>on</strong>g> <strong>on</strong> the Internet are<br />

described <strong>in</strong> §3.3.1.1. Reports of child abuse material that are made by the <strong>on</strong>l<strong>in</strong>e community are received<br />

by the report<strong>in</strong>g centre and subsequently passed <strong>on</strong> to other <strong>in</strong>stituti<strong>on</strong>s (associate report<strong>in</strong>g<br />

centres of INHOPE or the <str<strong>on</strong>g>Nati<strong>on</strong>al</str<strong>on</strong>g> Police Services). In the event that the c<strong>on</strong>tent is hosted <strong>in</strong> the<br />

Netherlands and is not removed with<strong>in</strong> a week, the hotl<strong>in</strong>e sends a notificati<strong>on</strong> to the provider. 851<br />

That seems to work <strong>in</strong> practice. Material is almost always removed follow<strong>in</strong>g a notificati<strong>on</strong> be<strong>in</strong>g<br />

issued to the provider. A more pro-active approach, such as the <strong>on</strong>e employed <strong>in</strong> the United K<strong>in</strong>gdom<br />

– by immediately remov<strong>in</strong>g the material as so<strong>on</strong> as possible follow<strong>in</strong>g notificati<strong>on</strong> – would<br />

be able to relieve the burden up<strong>on</strong> the police, whilst not affect<strong>in</strong>g the police’s objective to identify<br />

new victims. If the Hotl<strong>in</strong>e Combat<strong>in</strong>g <str<strong>on</strong>g>Child</str<strong>on</strong>g> <str<strong>on</strong>g>Pornography</str<strong>on</strong>g> <strong>on</strong> the Internet and its colleagues <strong>in</strong> other<br />

countries were able to resp<strong>on</strong>d to reports immediately, the most visible material – material <strong>on</strong><br />

upload services and commercial sites that is noticed by the <strong>on</strong>l<strong>in</strong>e community, which subsequently<br />

reports this to the report<strong>in</strong>g centre – would be able to be disrupted <strong>in</strong> a way that is probably<br />

more effective than a lengthy crim<strong>in</strong>al <strong>in</strong>vestigati<strong>on</strong> with an uncerta<strong>in</strong> outcome. This most visible<br />

market c<strong>on</strong>sists of sites that usually <strong>on</strong>ly recycle pre-exist<strong>in</strong>g material or material that c<strong>on</strong>stitutes<br />

child pornography that is already known, 852 and/or that display child pornography of the lightest<br />

category, 853 a part of which is hosted <strong>in</strong> the Netherlands. 854 This is, <strong>in</strong> brief, material that the police,<br />

with their limited capacity, do not regard as a priority. 855 Part of this material will then disappear;<br />

another part will probably re-locate to less accessible <strong>on</strong>l<strong>in</strong>e envir<strong>on</strong>ments 856 , <strong>on</strong> which police<br />

<strong>in</strong>vestigati<strong>on</strong>s may subsequently focus. In any case, child pornography will be more difficult for<br />

viewers to f<strong>in</strong>d. 857 Research reveals that the opportunities to remove child abuse material – even <strong>in</strong><br />

cases where material from other countries is be<strong>in</strong>g hosted – are sufficient. Internet service providers<br />

(ISPs) remove such material relatively quickly. 858 The European Electr<strong>on</strong>ic Commerce Directive<br />

(2000/31/EC) states that Internet providers are liable for any unlawful material bel<strong>on</strong>g<strong>in</strong>g to their<br />
