3 Implementati<strong>on</strong><br />

3.1 Introducti<strong>on</strong><br />

In Chapter 1 we described the variati<strong>on</strong> that exists am<strong>on</strong>gst perpetrators, victims and technology <strong>in</strong> relati<strong>on</strong><br />

to the phenomen<strong>on</strong> of child pornography. The picture that this creates is therefore a multi-faceted<br />

<strong>on</strong>e. That diversity with<strong>in</strong> the phenomen<strong>on</strong> must be reflected <strong>in</strong> policy and implementati<strong>on</strong>. However,<br />

the fact that child pornography is closely associated with – and sometimes forms part of – other types of<br />

sexual violence aga<strong>in</strong>st children, also has implicati<strong>on</strong>s for policy and implementati<strong>on</strong>. Although child<br />

abuse material exists primarily <strong>in</strong> digital format, perpetrators and victims exist <strong>in</strong> both the offl<strong>in</strong>e and<br />

<strong>on</strong>l<strong>in</strong>e worlds, and c<strong>on</strong>sequently the phenomen<strong>on</strong> of child pornography has both an analogue and a<br />

digital element.<br />

The previous chapter provided an overview of the government’s policy agenda over the past decades,<br />

which sought to create cohesi<strong>on</strong> between the strategy to tackle child pornography, specifically based<br />

up<strong>on</strong> Article 240b of the Dutch Crim<strong>in</strong>al Code (as it currently stands), and the policy that aims to protect<br />

children from sexual violence, (whether or not) as a form of child abuse. In terms of policy, the strategy<br />

to tackle child pornography is based up<strong>on</strong> a narrow legal framework, whilst the efforts to tackle sexual<br />

violence are implemented <strong>on</strong> a broader scale. However, elements of the strategy to tackle child pornography<br />

(the digital aspects of sexual violence aga<strong>in</strong>st children, the digital envir<strong>on</strong>ment used by the<br />

producer and possessor of such material, and the <strong>on</strong>l<strong>in</strong>e world of both perpetrators and victims) hardly<br />

ever form an <strong>in</strong>tegral part of the programmes that aim to tackle sexual violence aga<strong>in</strong>st children. Yet<br />

it is imperative that every effort is made to achieve cohesi<strong>on</strong> and coord<strong>in</strong>ati<strong>on</strong> between the different<br />

programmes, and that the digital element is also <strong>in</strong>cluded, if an effective policy <strong>in</strong> relati<strong>on</strong> to children’s<br />

(sexual) safety is to be achieved.<br />

As far as protect<strong>in</strong>g children from sexual violence is c<strong>on</strong>cerned, the focus up<strong>on</strong> the digital element also<br />

forms <strong>on</strong>e of the cornerst<strong>on</strong>es of the Lanzarote C<strong>on</strong>venti<strong>on</strong>. 1 This C<strong>on</strong>venti<strong>on</strong> is comprehensive and<br />

multi-discipl<strong>in</strong>ary <strong>in</strong> nature. In additi<strong>on</strong> to crim<strong>in</strong>al provisi<strong>on</strong>s and provisi<strong>on</strong>s impos<strong>in</strong>g sancti<strong>on</strong>s, it<br />

<strong>in</strong>corporates preventative and protective measures, as well as measures that ensure nati<strong>on</strong>al coord<strong>in</strong>ati<strong>on</strong><br />

and <strong>in</strong>ternati<strong>on</strong>al cooperati<strong>on</strong>. 2 The added value primarily lies <strong>in</strong> the fact that <strong>in</strong> ensur<strong>in</strong>g the<br />
