re-offend<strong>in</strong>g, 425 and therefore to scrap it entirely. The government <strong>in</strong>dicates <strong>in</strong> this regard that it does not<br />
c<strong>on</strong>sider it appropriate ‘to the character of the community service order that this could actually be imposed<br />
<strong>in</strong> the case of a sentence for a serious sexual abuse offence or violent offence, as referred to <strong>in</strong> the present<br />
legislative proposal.’ In a resp<strong>on</strong>se, the Dutch Probati<strong>on</strong> Service argued that by remov<strong>in</strong>g the possibility<br />
of impos<strong>in</strong>g a community service order <strong>in</strong> comb<strong>in</strong>ati<strong>on</strong> with a suspended sentence, the ability of courts to<br />
impose a sancti<strong>on</strong> that is appropriate for the crim<strong>in</strong>al offence and for the offender is reduced, <strong>in</strong>clud<strong>in</strong>g<br />
and partly for the preventi<strong>on</strong> of repeat offences and therefore new victims. 426 The Council for the Judiciary<br />
also po<strong>in</strong>ts out obstacles <strong>in</strong> practice, and thereby states that limit<strong>in</strong>g the freedom of the courts to determ<strong>in</strong>e<br />
the punishment could frequently lead to sentences be<strong>in</strong>g imposed that are not proporti<strong>on</strong>al to the<br />
offence committed. 427 “Furthermore, the proposal means that the specific opportunities that community<br />
service orders provide for the realisati<strong>on</strong> of modificati<strong>on</strong> of behaviour and reduc<strong>in</strong>g repeat offend<strong>in</strong>g, can<br />
no l<strong>on</strong>ger be of use.” 428 In March 2011, an amended legislative proposal f<strong>in</strong>ally emerged, which stated that<br />
a community service order would no l<strong>on</strong>ger be possible unless, and <strong>on</strong>ly if, it is imposed <strong>in</strong> comb<strong>in</strong>ati<strong>on</strong><br />
with a n<strong>on</strong>-suspended sentence or orders that <strong>in</strong>volve deprivati<strong>on</strong> of freedom. 429 It is, <strong>in</strong> this case, <strong>on</strong>ly possible<br />
to comb<strong>in</strong>e the community service order with a sentence of no l<strong>on</strong>ger than six m<strong>on</strong>ths. 430<br />
At the time of writ<strong>in</strong>g, the legislative proposal is under discussi<strong>on</strong> <strong>in</strong> the Senate of the Dutch Parliament.<br />
