The phenomen<strong>on</strong> of child pornography<br />

which <strong>in</strong> practice can result <strong>in</strong> a broad <strong>in</strong>terpretati<strong>on</strong>. The term ‘child pornography’ is not def<strong>in</strong>ed, is too<br />

vague or does not dist<strong>in</strong>guish between adult pornographic material <strong>in</strong> general and child abuse material.<br />

It seems that European countries are tak<strong>in</strong>g clear-cut steps – as a result of the <strong>in</strong>struments of the Council<br />

of Europe and the EU – to crim<strong>in</strong>alise both real-world and simulated acts, whilst this is still a highly<br />

c<strong>on</strong>troversial issue outside of Europe. Despite the fact that <strong>in</strong> many cases the perpetrators are <strong>in</strong>dividuals<br />

who are <strong>in</strong> close c<strong>on</strong>tact with children, the majority of the legislati<strong>on</strong> analysed does not c<strong>on</strong>ta<strong>in</strong> any<br />

specific penal provisi<strong>on</strong>s with regard to the abuse of a recognised positi<strong>on</strong> of trust or custody of a child<br />

or <strong>in</strong>fluence up<strong>on</strong> him/her, <strong>in</strong>clud<strong>in</strong>g with<strong>in</strong> the family. The applicati<strong>on</strong> of exist<strong>in</strong>g provisi<strong>on</strong>s is limited<br />

<strong>in</strong> some countries by c<strong>on</strong>troversial c<strong>on</strong>diti<strong>on</strong>s, for example, that the victim is a female m<strong>in</strong>or, that the act<br />

took place aga<strong>in</strong>st the will of a m<strong>in</strong>or, that the perpetrator must be at least 18 years of age, that violence<br />

or <strong>in</strong>timidati<strong>on</strong> must have been <strong>in</strong>volved, or that an ‘<strong>in</strong>decent act’ <strong>in</strong>volv<strong>in</strong>g violence was committed. 154<br />

At present, there are still some countries that do not have any specific crim<strong>in</strong>al legislati<strong>on</strong> <strong>in</strong> place<br />

c<strong>on</strong>cern<strong>in</strong>g child pornography. Accord<strong>in</strong>g to the most recent <strong>in</strong>ventory drawn up by the Internati<strong>on</strong>al<br />

Centre for Miss<strong>in</strong>g & Exploited <str<strong>on</strong>g>Child</str<strong>on</strong>g>ren (ICMEC), this is the case <strong>in</strong> as many as 89 of the 196 countries<br />

that were studied. 155 Of the countries that do have any specific nati<strong>on</strong>al legislati<strong>on</strong> <strong>in</strong> place, 52 countries<br />

do not def<strong>in</strong>e the term ‘child pornography’ <strong>in</strong> a separate statutory penal provisi<strong>on</strong>, 18 countries do not<br />

<strong>in</strong>clude any computer-related (and particularly Internet-related) offences <strong>in</strong> their crim<strong>in</strong>al legislati<strong>on</strong>,<br />

and 33 countries have crim<strong>in</strong>alised <strong>in</strong>tenti<strong>on</strong>al possessi<strong>on</strong> without <strong>in</strong>tent to distribute the material. 156<br />

Accord<strong>in</strong>g to this <strong>in</strong>ventory, <strong>on</strong>ly 45 countries have legislati<strong>on</strong> <strong>in</strong> place that can actually be used to tackle<br />

child pornography, as they fulfil the criteria set by the ICMEC. The Netherlands is regarded as <strong>on</strong>e of<br />

those countries. Only eight countries fulfil all the criteria set <strong>in</strong> this report, namely Australia, Belgium,<br />

Columbia, France, Italy, the Philipp<strong>in</strong>es, South Africa and the United States of America. 157 A fifth criteri<strong>on</strong><br />

c<strong>on</strong>cerns ISPs that are required to report child abuse material to the police or another mandated agency.<br />

In the Netherlands, ISPs are not obliged to report material, although a practice to report and remove<br />

child abuse material exists (see §3.8). 158<br />

Recent legislative amendments<br />

In 2009, the maximum sentence <strong>in</strong> Article 240b, paragraph 2 of the Dutch Crim<strong>in</strong>al Code was <strong>in</strong>creased<br />

from six to eight years. 159 This created the possibility of deploy<strong>in</strong>g greater powers that are important <strong>in</strong><br />
