12 Here, aggravated child pornography c<strong>on</strong>sists exclusively of ‘mak<strong>in</strong>g a habit or professi<strong>on</strong> of child pornography’<br />

(Article 240b Paragraph 2 of the Dutch Crim<strong>in</strong>al Code, whether or not <strong>in</strong> comb<strong>in</strong>ati<strong>on</strong> with<br />

Paragraph 1). In two <strong>in</strong>stances, Article 248 (paragraph 1 <strong>in</strong> <strong>on</strong>e <strong>in</strong>stance and paragraph 2 <strong>in</strong> the other –<br />

both <strong>in</strong> 2010) is recorded as the gravest offence. However, <strong>in</strong> view of the fact that this is recorded <strong>on</strong> a<br />

case level (and therefore not <strong>on</strong> an offence level), it is not possible to determ<strong>in</strong>e whether Article 248<br />

appears with<strong>in</strong> the same offence as child pornography. As such, it is c<strong>on</strong>ceivable that the circumstances<br />

of Article 248 that attract a more severe penalty relate to a sexual offence other than child pornography.<br />

This may be a sexual offence committed up<strong>on</strong> a m<strong>in</strong>or, but may also be a sexual offence committed<br />

up<strong>on</strong> an adult. Therefore, these two cases have been categorised under ‘other sexual offences.’<br />
