C<strong>on</strong>clusi<strong>on</strong>s and recommendati<strong>on</strong>s<br />
it is almost impossible to draft a policy. The m<strong>in</strong>imal capacity available has also been designated as a<br />
cause for the number of pend<strong>in</strong>g cases. This is the issue, however, as the backlog of cases should <strong>in</strong>crease<br />
if an additi<strong>on</strong>al 100 to 300 cases are received every year. This is not happen<strong>in</strong>g, though; although the<br />
number of pend<strong>in</strong>g cases cannot be c<strong>on</strong>trolled, it is nevertheless relatively stable, and even decreases<br />
now and then. An <strong>in</strong>vestigati<strong>on</strong> of the <strong>in</strong>flow and outflow of the pend<strong>in</strong>g cases could provide an <strong>in</strong>sight<br />
<strong>in</strong>to this situati<strong>on</strong>. The existence of pend<strong>in</strong>g cases may potentially be the result of the low priority that<br />
is assigned to child pornography cases, the work<strong>in</strong>g method be<strong>in</strong>g used, or the <strong>in</strong>flux of <strong>in</strong>vestigati<strong>on</strong>s<br />
from other countries. The assumpti<strong>on</strong> that a shortage <strong>in</strong> capacity is the cause of the backlog of cases is<br />
partly unfounded. A potential soluti<strong>on</strong> could be to develop an <strong>in</strong>ternati<strong>on</strong>al prioritisati<strong>on</strong> model. To<br />
this end, the possibilities for mak<strong>in</strong>g <strong>in</strong>ternati<strong>on</strong>al agreements <strong>in</strong> this regard could be explored further.<br />
Two challenges that need to be dealt with, regardless of changes to the police structure, <strong>in</strong>volve the effectiveness<br />
of victim identificati<strong>on</strong>. For this purpose, parties could seek alignment with cases of sexual<br />
abuse, <strong>in</strong> which data storage media must always be seized. After all, seek<strong>in</strong>g to identify victims via the<br />
Internet is not always effective and it frequently occurs by chance. The Implementati<strong>on</strong> Provisi<strong>on</strong>s c<strong>on</strong>cern<strong>in</strong>g<br />
<str<strong>on</strong>g>Child</str<strong>on</strong>g> <str<strong>on</strong>g>Pornography</str<strong>on</strong>g> now state that when forms of sexual violence aga<strong>in</strong>st children are reported,<br />
the possibility that child abuse material may have been produced must be taken <strong>in</strong>to account at all<br />
stages of the <strong>in</strong>vestigati<strong>on</strong>, and a search must be carried out, if possible. By emphasis<strong>in</strong>g the importance<br />
of seizure of data storage media <strong>in</strong> both the Implementati<strong>on</strong> Provisi<strong>on</strong>s c<strong>on</strong>cern<strong>in</strong>g <str<strong>on</strong>g>Child</str<strong>on</strong>g> <str<strong>on</strong>g>Pornography</str<strong>on</strong>g><br />
and the Implementati<strong>on</strong> Provisi<strong>on</strong>s c<strong>on</strong>cern<strong>in</strong>g Public Decency Offences, the efficacy of detecti<strong>on</strong> can<br />
be improved and the focus can actually be shifted to the abuse. Sec<strong>on</strong>dly, more <strong>in</strong>formati<strong>on</strong> regard<strong>in</strong>g<br />
the effectiveness of detecti<strong>on</strong> needs to be collected. For example, the number of victims that were found<br />
via the Internet is practically unknown. For that reas<strong>on</strong>, details of victims must be recorded. As a result,<br />
we will have greater <strong>in</strong>sight <strong>in</strong>to the effectiveness of detecti<strong>on</strong>, which may have implicati<strong>on</strong>s for the<br />
policy to be implemented.<br />
4.2.3.5 Prosecuti<strong>on</strong> and trial<br />
Article 240b of the Dutch Crim<strong>in</strong>al Code encompasses various forms of c<strong>on</strong>duct, rang<strong>in</strong>g from ga<strong>in</strong><strong>in</strong>g<br />
access to and possessi<strong>on</strong> of child abuse material to its producti<strong>on</strong> and distributi<strong>on</strong>. The formulati<strong>on</strong> of<br />
the secti<strong>on</strong> of the law does not, from the statistical material, lay out how prosecuti<strong>on</strong> and trial relate to<br />
the various forms of c<strong>on</strong>duct. A formulati<strong>on</strong> c<strong>on</strong>sist<strong>in</strong>g of various categories should be taken <strong>in</strong>to c<strong>on</strong>siderati<strong>on</strong>.<br />
It is possible that the new forthcom<strong>in</strong>g EU Directive provides occasi<strong>on</strong> for a re-exam<strong>in</strong>ati<strong>on</strong><br />
of the formulati<strong>on</strong> of the current provisi<strong>on</strong> of penalties.<br />
The above dist<strong>in</strong>cti<strong>on</strong> between various forms of c<strong>on</strong>duct is also relevant for impos<strong>in</strong>g sentences. In<br />
practice, the court usually imposes a suspended custodial sentence <strong>in</strong> comb<strong>in</strong>ati<strong>on</strong> with a community<br />
service order. From the figures, there appears to be a clear tendency towards impos<strong>in</strong>g more severe<br />
sentences: the proporti<strong>on</strong> of n<strong>on</strong>-suspended or partially suspended custodial sentences <strong>in</strong>creased <strong>in</strong><br />
the period between 2006 and 2010 and <strong>in</strong> 2010, a community service order was imposed less often as<br />
the ma<strong>in</strong> sentence. At present, it is still unclear if, and to what extent, the possibilities for impos<strong>in</strong>g<br />
community service orders will be limited <strong>in</strong> the future for cases <strong>in</strong>volv<strong>in</strong>g a breach of Article 240b of<br />
the Dutch Crim<strong>in</strong>al Code. Limit<strong>in</strong>g the possibilities to impose a community service order, particularly if<br />
this would no l<strong>on</strong>ger be possible <strong>in</strong> comb<strong>in</strong>ati<strong>on</strong> with suspended sentences, would <strong>in</strong> any case, provide<br />
courts with fewer opportunities to tailor the sentence to the <strong>in</strong>dividual case. In this c<strong>on</strong>text, possibilities<br />
for <strong>in</strong>fluenc<strong>in</strong>g behaviour by means of supervisi<strong>on</strong> <strong>on</strong> the basis of c<strong>on</strong>diti<strong>on</strong>s imposed for a suspended<br />
sentence, for example, must also be taken <strong>in</strong>to c<strong>on</strong>siderati<strong>on</strong>.<br />
