2.2 Policy developments s<strong>in</strong>ce the early 1980s<br />

This secti<strong>on</strong> will describe developments to policy <strong>in</strong>stigated by various (government) bodies, which<br />

have been directed towards combat<strong>in</strong>g child pornography and sexual violence aga<strong>in</strong>st children. Other<br />

committees and work<strong>in</strong>g groups, often appo<strong>in</strong>ted by a m<strong>in</strong>istry, as well as <strong>in</strong>ternati<strong>on</strong>al c<strong>on</strong>ferences<br />

and agreements, have also played a role <strong>in</strong> the development of policy. A government-wide <strong>in</strong>itiative (the<br />

NAPS) was <strong>in</strong>tended to expand the exist<strong>in</strong>g measures directed towards tackl<strong>in</strong>g sexual violence aga<strong>in</strong>st<br />

children, but ended prematurely after a lengthy <strong>in</strong>troductory period. 1<br />

This secti<strong>on</strong> starts with the situati<strong>on</strong> <strong>in</strong> the mid-1980s, a period <strong>in</strong> which debate about child pornography<br />

first arose. 2 In July 1984, the Amsterdam police force raided sex shops and seized any child abuse material<br />

that was present. In November 1984, hear<strong>in</strong>gs related to child pornography were held <strong>in</strong> the United States<br />

by the Senate Permanent Subcommittee <strong>on</strong> Investigati<strong>on</strong>s, chaired by Senator Roth. In these hear<strong>in</strong>gs, the<br />

Netherlands was accused of c<strong>on</strong>tribut<strong>in</strong>g to the producti<strong>on</strong> of child abuse material, and for that reas<strong>on</strong>,<br />

the topic became a cause of discussi<strong>on</strong>. 3 In the early 1980s, the development of child pornography legislati<strong>on</strong><br />

was also beg<strong>in</strong>n<strong>in</strong>g to take shape. 4 The commoti<strong>on</strong> surround<strong>in</strong>g child pornography was not the <strong>on</strong>ly<br />

relevant aspect. In 1982, the so-called Kijkdu<strong>in</strong> C<strong>on</strong>ference <strong>on</strong> sexual violence aga<strong>in</strong>st women and girls took<br />

place, and this marked the start of government <strong>in</strong>terventi<strong>on</strong>s <strong>in</strong> the area of sexual violence aga<strong>in</strong>st children. 5<br />

The government began to take resp<strong>on</strong>sibility. The first policy document <strong>on</strong> ‘sexual violence aga<strong>in</strong>st women<br />

and girls’ was published <strong>in</strong> 1984. 6 From that time <strong>on</strong>wards, the issue of ‘sexual violence’ began to<br />

be <strong>in</strong>corporated, <strong>on</strong>e step at a time, <strong>in</strong>to government policy, and it was not <strong>on</strong>ly the Directorate for the<br />

Co-ord<strong>in</strong>ati<strong>on</strong> of Emancipati<strong>on</strong> Policy of the M<strong>in</strong>istry of Social Affairs and Employment that was <strong>in</strong>volved<br />

with this matter; the M<strong>in</strong>istry of Justice and the M<strong>in</strong>istry of Health, Welfare and Sport (the M<strong>in</strong>istry of<br />

Health, Welfare and Culture at the time) also became <strong>in</strong>volved 7 . S<strong>in</strong>ce then, the topic has rema<strong>in</strong>ed part<br />

of the government’s agenda, although this has, of course, been accompanied with ups and downs and<br />

a variety of viewpo<strong>in</strong>ts <strong>in</strong> terms of visi<strong>on</strong> and approach that existed between the various m<strong>in</strong>istries. 8<br />

As will become apparent, the approach employed for tackl<strong>in</strong>g child pornography was predom<strong>in</strong>antly<br />

repressive, and predom<strong>in</strong>antly a matter for the co-operat<strong>in</strong>g organisati<strong>on</strong>s with<strong>in</strong> the judicial doma<strong>in</strong>.<br />

In June 1985, partly as a result of the comments from the United States, the M<strong>in</strong>ister of Justice at the<br />

time appo<strong>in</strong>ted a <str<strong>on</strong>g>Child</str<strong>on</strong>g> <str<strong>on</strong>g>Pornography</str<strong>on</strong>g> Work<strong>in</strong>g Group, under the leadership of the public prosecutor De<br />

Wit. The work<strong>in</strong>g group was assigned the task of catalogu<strong>in</strong>g <strong>in</strong>formati<strong>on</strong> about child pornography <strong>in</strong><br />
