<strong>on</strong> Cybercrime of the Council of Europe 813 and the Electr<strong>on</strong>ic Commerce Directive of the EU 814 . 815 S<strong>in</strong>ce<br />
ISPs now facilitate access to the Internet for many c<strong>on</strong>sumers, there is <strong>in</strong>creas<strong>in</strong>g pressure <strong>on</strong> the ISPs<br />
to take measures, of their own accord, to prevent the distributi<strong>on</strong> of child abuse material. 816 Preventive<br />
measures that have been proposed <strong>in</strong>clude the record<strong>in</strong>g of the identity of the operator of a website and<br />
the <strong>in</strong>stallati<strong>on</strong> of filters when upload<strong>in</strong>g c<strong>on</strong>tent, which are both to be carried out by host<strong>in</strong>g providers,<br />
and measures such as data retenti<strong>on</strong>, the record<strong>in</strong>g of users, block<strong>in</strong>g access to websites c<strong>on</strong>ta<strong>in</strong><strong>in</strong>g<br />
child abuse material, and block<strong>in</strong>g the distributi<strong>on</strong> of documents c<strong>on</strong>ta<strong>in</strong><strong>in</strong>g such material, which are<br />
to be carried out by access providers. 817 Certa<strong>in</strong> proposals are already be<strong>in</strong>g applied. For example, ISPs<br />
are already limit<strong>in</strong>g access to certa<strong>in</strong> newsgroups with<strong>in</strong> Usenet. 818 On the <strong>on</strong>e hand, ISPs are regarded<br />
as organisati<strong>on</strong>s that may be able to fulfil a key role <strong>in</strong> tackl<strong>in</strong>g child pornography, 819 whereas <strong>on</strong> the<br />
other hand the measures stated above may violate fundamental rights of users, may not be effective<br />
and/or may entail high costs. 820 The character of the Internet (see §1.2.3) makes clear that self-regulat<strong>in</strong>g<br />
measures <strong>on</strong> behalf of ISPs are most effective whenever they are applied <strong>on</strong> an <strong>in</strong>ternati<strong>on</strong>al level as opposed<br />
to <strong>on</strong> an <strong>in</strong>dividual or nati<strong>on</strong>al level. This type of <strong>in</strong>ternati<strong>on</strong>al partnership should also be able<br />
to c<strong>on</strong>tribute to the identificati<strong>on</strong> of mala fide ISPs 821 . In additi<strong>on</strong> to ISPs, the Internet Corporati<strong>on</strong> for<br />
Assigned Names and Numbers (ICANN) also plays a role <strong>in</strong> manag<strong>in</strong>g the (technical) <strong>in</strong>frastructure of<br />
the Internet. 822 For this reas<strong>on</strong>, follow<strong>in</strong>g remarks from an Interpol employee that the identity details<br />
(Whois) are not always accurate 823 , ICANN and Interpol have announced a partnership to improve Internet<br />
safety and combat cyber-crime, <strong>in</strong>clud<strong>in</strong>g, am<strong>on</strong>g other offenses, that of child pornography. 824<br />
The manner <strong>in</strong> which this partnership will be compiled is not yet known. In additi<strong>on</strong> to this, ICANN has<br />
recently <strong>in</strong>troduced the.xxx extensi<strong>on</strong> for (adult) pornographic websites. It is expected that this exten-<br />

mean that it is desirable to place it with<strong>in</strong> a more clearly-def<strong>in</strong>ed legal framework, for example for reas<strong>on</strong>s of legal<br />
