<str<strong>on</strong>g>Child</str<strong>on</strong>g> PornograPhy First report oF the Dutch NatioNal rapporteur<br />
the producti<strong>on</strong> of pornography or for pornographic performances. It is a short c<strong>on</strong>venti<strong>on</strong> that, <strong>in</strong> a<br />
similar way to the Opti<strong>on</strong>al Protocol to the UN C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> the Rights of the <str<strong>on</strong>g>Child</str<strong>on</strong>g>, not <strong>on</strong>ly requires<br />
Member States to put penal or other sancti<strong>on</strong>s <strong>in</strong> place, but also to take measures to prevent these forms<br />
of child labour, and to provide assistance <strong>in</strong> these matters. 132 Other relevant c<strong>on</strong>venti<strong>on</strong>s to which the<br />
Netherlands is also a signatory are the C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> Cybercrime (2001) 133 and the Lanzarote C<strong>on</strong>venti<strong>on</strong><br />
(2007) 134 of the Council of Europe.<br />
Ratificati<strong>on</strong> of the Lanzarote C<strong>on</strong>venti<strong>on</strong> gave rise to the <strong>in</strong>troducti<strong>on</strong> of crim<strong>in</strong>al legislati<strong>on</strong> c<strong>on</strong>cern<strong>in</strong>g<br />
corrupti<strong>on</strong> and groom<strong>in</strong>g (Article 248d and 248e of the Dutch Crim<strong>in</strong>al Code) <strong>in</strong> the Netherlands.<br />

Corrupti<strong>on</strong><br />
Article 22 of the Lanzarote C<strong>on</strong>venti<strong>on</strong> stipulates that States must crim<strong>in</strong>alise the act of <strong>in</strong>tenti<strong>on</strong>ally<br />
caus<strong>in</strong>g a child below the age of c<strong>on</strong>sent to witness sexual abuse or sexual activities for<br />
sexual purposes (the corrupti<strong>on</strong> of children). 136 The child is not required to participate <strong>in</strong> the<br />
sexual activities <strong>in</strong> order to have such an activity c<strong>on</strong>stitute an offence (corrupti<strong>on</strong>). This penal<br />
provisi<strong>on</strong> is new, <strong>in</strong> comparis<strong>on</strong> with exist<strong>in</strong>g <strong>in</strong>ternati<strong>on</strong>al <strong>in</strong>struments. The aim of this provisi<strong>on</strong><br />
is to protect the child from harmful <strong>in</strong>fluences up<strong>on</strong> their pers<strong>on</strong>al and sexual development,<br />
which <strong>in</strong> particular c<strong>on</strong>cern activities that aim to make a child susceptible to sexual exploitati<strong>on</strong><br />
or sexual abuse. 137<br />
Groom<strong>in</strong>g<br />
Article 23 of the Lanzarote C<strong>on</strong>venti<strong>on</strong> c<strong>on</strong>ta<strong>in</strong>s an obligati<strong>on</strong> to crim<strong>in</strong>alise mak<strong>in</strong>g c<strong>on</strong>tact with<br />
children for sexual purposes. In the C<strong>on</strong>venti<strong>on</strong> this is understood to mean if an adult c<strong>on</strong>tacts<br />
and seduces a child under the age of c<strong>on</strong>sent <strong>on</strong> websites or chat rooms with the ultimate aim of<br />
sexually abus<strong>in</strong>g that m<strong>in</strong>or. 138 The behaviour of the perpetrator must materialise <strong>in</strong>to a proposal<br />
to meet the child followed by a c<strong>on</strong>crete acti<strong>on</strong> that aims to make that meet<strong>in</strong>g a reality, accord<strong>in</strong>g<br />
