metal colossus” <strong>in</strong> M<strong>and</strong>ela’s image at the harbour entrance. <strong>The</strong> statue was planned to be<br />

65 metres high, one‐<strong>and</strong>‐a‐half times the size of the Statue of Liberty, <strong>and</strong> <strong>in</strong> its orig<strong>in</strong>al<br />

design, proposed the enlarged M<strong>and</strong>ela with a clenched‐fist salute, hold<strong>in</strong>g a copy of his<br />

book, Long Walk to Freedom. With “discomfort <strong>in</strong> some quarters”, this plan was shelved <strong>in</strong><br />

favour of one with an open h<strong>and</strong>, with a figure of a young girl bear<strong>in</strong>g a bowl added.<br />

Called the “Statue of Freedom”, the giant statue was <strong>in</strong>tended as “a symbol of humanity’s<br />

struggle for freedom”. It would be fronted by a 600 metre “long walk to freedom”, <strong>and</strong> its<br />

45‐metre pl<strong>in</strong>th would house “a museum of freedom” celebrat<strong>in</strong>g national liberation<br />

struggles around the world. Because he had worried about “be<strong>in</strong>g built up <strong>in</strong>to a<br />

tremendous cult figure”, <strong>and</strong> about be<strong>in</strong>g depicted as “the lone leader”, M<strong>and</strong>ela had<br />

<strong>in</strong>dicated his discomfort with the idea of this statue, but at the same time admitted his<br />

awareness of the “commercial <strong>in</strong>terest beh<strong>in</strong>d it” <strong>and</strong> of its potential as “tourist<br />

attraction”. 272<br />

It is not certa<strong>in</strong> what the response of the Nelson M<strong>and</strong>ela Foundation (NMF) was to the<br />

idea of an outsize M<strong>and</strong>ela statue, s<strong>in</strong>ce they had taken on responsibility for management<br />

of the M<strong>and</strong>ela br<strong>and</strong>. Established <strong>in</strong> 1999 as “the primary vehicle” to “lead <strong>and</strong> direct the<br />

development of a liv<strong>in</strong>g legacy that captures the vision <strong>and</strong> values” of M<strong>and</strong>ela’s life <strong>and</strong><br />

work, the NMF became the adm<strong>in</strong>istrative <strong>in</strong>frastructure mediat<strong>in</strong>g his ongo<strong>in</strong>g<br />

<strong>in</strong>volvement <strong>in</strong> public life. <strong>The</strong> NMF also sought to regulate the reproduction <strong>and</strong> sale of<br />

M<strong>and</strong>ela’s image <strong>and</strong> the use of his name <strong>in</strong> commercial or public sett<strong>in</strong>gs. It <strong>in</strong>voked the<br />

old 1941 Merch<strong>and</strong>ise Marks Act that protects national symbols to prevent artists from the<br />

unauthorised “quot<strong>in</strong>g” of M<strong>and</strong>ela’s image. Yiul Damaso, an artist who had depicted<br />

<strong>and</strong> sold pa<strong>in</strong>t<strong>in</strong>gs of M<strong>and</strong>ela as Rastafarian <strong>and</strong> boxer, among other guises, <strong>and</strong> who<br />

had sold his works from a S<strong>and</strong>ton Square restaurant dur<strong>in</strong>g the 2002 World Summit on<br />

Susta<strong>in</strong>able Development, was ordered by the NMF to stop pa<strong>in</strong>t<strong>in</strong>g M<strong>and</strong>ela images.<br />

NMF lawyer, Ishmael Ayob, also <strong>in</strong>structed an “unemployed, self‐taught” KwaZulu‐Natal<br />
