B. Bids shall be submitted at the time and place indicated in the Invitation to Bid and shall be
enclosed in an opaque sealed envelope, marked with:
WARD COUNTY WATER SUPPLY EXPANSION PROJECT – NORTH WELL FIELD
BID PACKAGE #8 - RAW WATER SUPPLY WELL SITES – WARD COUNTY – NORTH WELL FIELD
FOR
COLORADO RIVER MUNICIPAL WATER DISTRICT

and accompanied by all required documents. Bidder will acknowledge on outside of envelope
any addenda.
Any Bid received after the time indicated in the invitation will be considered ineligible and
returned unopened.
C. Bids may be rejected that are qualified with conditions, clauses, or alterations, or items not
called for in the proposal, or irregularities of any kind in which the Owner / Engineers/
CMAR’s opinion may disqualify the Bidder.
9. Modifications and Withdrawal of Bids
A. Bids may be modified or withdrawn by an appropriate document duly executed and delivered
to the place where Bids are to be submitted at any time prior to the opening of Bids.
10. Bids to Remain Subject to Acceptance
A. All bids will remain subject to acceptance for sixty (60) days after the day of the Bid opening,
but Owner, Engineers and CMAR may, in their sole discretion, release any Bid prior to that
date.
11. Award of Contract
A. Owner and Engineers reserve the right to reject any and all Bids, to waive any and all
informalities not involving price, time or changes in the Work and to negotiate contract terms with
the Successful Bidder and the right to disregard all nonconforming, nonresponsive, unbalanced or
conditional Bids. In the event that there is a conflict in the statement of a price within the bid the
Owner and Engineers reserve the right to select the amount most advantageous to the Owner.
Also, Owner and/or Engineers reserve the right to reject the Bid of any Bidder if Owner and/or
Engineers believe that it would not be in the best interest of the Project to make an award to that
Bidder, whether because the Bid is not responsive or the Bidder is unqualified or of doubtful
financial ability or fails to meet any other pertinent standard or criteria established by Owner /
Engineers.
