Contract Description. 2. Work by Seller. 3. Contract Time and General Order of Construction. 4. Approval of Equipment and Materials. 5. Warranty. 1.2 Contract Description A. The project includes furnishing twenty-one (21) deep well submersible turbine pumping units for use in constructed municipal potable water wells located in Ward County, Texas, USA for the Colorado River Municipal Water District (CRMWD). The wells have been previously constructed under a separate contract and their final capacities determined for the purpose of sizing pumping equipment. B. Contract Type is unit price basis for work actually performed and measured. C. Seller shall make every effort to sequentially deliver all equipment to the project site as stipulated in the Contract Documents. 1.3 Work by Seller A. The Seller shall perform all the Work specified in the individual specification sections, including the following: 1. Provide labor, equipment, and materials to construct and furnish submersible pumping units and appurtenances. 2. Deliver specified products in a timely manner and as required by the Contract Documents. 3. Provide the services of a competent factory-trained field service technical representative for each pump installation. Representative’s duties shall include assisting the installation contractor (not this Contract) with the installation of the equipment assuring proper alignment and coupling, testing, and instructing the owner on proper operation and maintenance of the equipment. 4. Provide certified testing reports and field measurements necessary to demonstrate efficiency(ies) required by the Contract Documents can be validated. Other required testing will include shop testing of pump and motor to provide certified test curves prior to acceptance. 5. With assistance from the Engineer, coordinate delivery of pumping equipment with the installation contractor. 6. Provide submittals in accordance with Section 01300 Submittals. Completion of the project within the time allotted is of the essence. The Seller shall commit all necessary forces and equipment to complete the project within the milestones specified in the Contract Documents. B. Manufacturing sequence of submersible pumping units will coincide with well installation and testing. After pumping tests have been performed for a particular group of wells, an order will be placed for particular pumping units. Each well will be complete and available to receive pumping equipment when the unit is delivered. 1.5 Approval of Equipment and Materials A. All materials shall be new and shall be designed for the function and service specified herein. No materials shall be used in the project except those that have been approved by the Engineer. B. Approval for installation or incorporation in the project will be given only after submittal and subsequent examination of shop and installation drawings, manufacturer's specifications, test results, or other data required in the various sections of these specifications. Final approval and acceptance of items will be made only after such items are in operation and have met all specified tests. 1.6 Warranty A. Seller shall warrant 100 percent of the project for one (1) year after the date of final acceptance of the Work. B. Seller shall remedy any defects in material workmanship, and pay for any and all damages of any nature whatsoever resulting in defects in materials and workmanship at no cost to the Owner. Seller will also be obligated to pay for all expenses incurred by Owner in notification of claim, administration, engineering, Resident Project Representative (RPR) services, and other warranty related expenses to Owner. C. Seller shall be responsible for all costs associated with pulling and reinstalling pumping equipment found to be defective in materials and/or workmanship within the warranty period.
