La partición legalmente hecha, fija la porción de bienes hereditarios quecorresponde a cada uno de los herederos.Artículo 946. Cuando por causas anteriores a la partición, alguno de los coherederos fueseprivado de todo o de parte de su haber, los otros coherederos están obligados aindemnizarle de esa pérdida, en proporción a sus derechos hereditarios.Artículo 947. La porción que deberá pagarse al que pierda su parte, no será la querepresente su haber primitivo, sino la que le corresponda, deduciendo del total de laherencia la parte perdida.Artículo 948. Si alguno de los coherederos estuviere insolvente, la cuota con que debíacontribuir se repartirá entre los demás, incluso el que perdió su parte.Artículo 949. Los que pagaren por el insolvente, conservarán su acción contra él, paracuando mejore de fortuna.Artículo 950. La obligación a que se refiere el artículo 946 sólo cesará en los casossiguientes:I. Cuando se hubiere dejado al heredero bienes individualmente determinados, de los cualeses privado;II. Cuando al hacerse la partición, los coherederos renuncien expresamente el derecho deser indemnizados; y,III. Cuando la pérdida fuere ocasionada por culpa del heredero que la sufre.Artículo 951. Si se adjudica como cobrable un crédito, los coherederos no responden de lainsolvencia posterior del deudor hereditario, y sólo son responsables de su solvencia altiempo de hacerse la partición.Artículo 952. Por los créditos incobrables no hay responsabilidad.Artículo 953. El heredero cuyos bienes hereditarios fueren embargados, o contra quien sepronunciare sentencia en juicio por causa de ellos, tiene derecho de pedir que suscoherederos, caucionen la responsabilidad que pueda resultarle y, en caso contrario, que seles prohíba enajenar los bienes que recibieron.CAPÍTULO VIIIfile:///C|/Documents%20and%20Settings/jcasares/Escritorio/zcc/16codciv.htm (100 of 238)27/04/2009 01:23:52 p.m.

Las particiones pueden rescindirse o anularse por las mismas causas que lasobligaciones.Artículo 955. El heredero preterido tiene derecho de pedir la nulidad de la partición.Decretada ésta, se hará una nueva partición para que perciba la parte que le corresponda.Artículo 956. La partición hecha con un heredero falso, es nula en cuanto tenga relación conél, y la parte que se le aplicó se distribuirá entre los herederos.Artículo 957.
