The Factories Act, 1990<br />

The Factories Act 1990 (FA) is the primary law regulating the health, safety<br />

and welfare of workers in the country’s factories. The law holds management<br />

and staff personally responsible for violations of the provisions in the Act.<br />

With respect to safety, there are general provisions as to the securing, fixing,<br />

usage, maintenance and storage of prime movers, transmission machinery,<br />

other machinery, unfenced machinery, dangerous liquids, automated<br />

machines, hoists and lifts, chains, ropes and lifting tackle, cranes and other<br />

lifting machines, steam boilers, steam receivers and containers, and air<br />

receivers. There are, in addition to these, standards set for the training and<br />

supervision of inexperienced workers, safe access to any work place, first aid<br />

boxes, prevention of fire, and safety arrangements in case of fire.<br />

The law requires that all accidents and industrial diseases be notified to the<br />

nearest inspector of factories and be investigated. The Act also prohibits the<br />

owner or occupier of a factory from making any deductions from the wages of<br />

any employee in respect of anything to be done or provided in pursuance of<br />

the FA.<br />

<strong>Environmental</strong> <strong>Impact</strong> Assessment Act No 86 (1992) - Public Participation and<br />

Disclosure in EIA Planning<br />

To a large extent, public authorities are required to inform the public of<br />

environment-related issues. Section 6(b) of the FEPA Act provides that FEPA<br />

has the power to collect and make available through publications and other<br />

appropriate means and in cooperation with public or private organisations,<br />

information pertaining to pollution and environmental protection regulations.<br />

Section 55 of the EIA Act provides for the maintenance of a Public Registry for<br />

the purpose of facilitating public access to records relating to environmental<br />

assessments. The FMEnv issues guidelines from time to time for<br />

environmental impact assessments for different industries and it also has<br />

publications that inform the public of the prohibition of environmental<br />

pollution.<br />

Furthermore, members of the public and persons requiring clarifications on<br />

environmental issues can visit the offices of the FMEnv or the relevant State<br />

environmental agency for environment-related information. Public hearings<br />

to which interested members of the public are invited are a key part of the<br />

approval process for EIA reports by the FMEnv.<br />

1.4.5 National <strong>Environmental</strong> Guidelines and Standards<br />

The National Guidelines and Standards for <strong>Environmental</strong> Pollution Control<br />

in Nigeria (NGSEPCN) were defined in March 1991 to serve as a basic<br />
