The provisions <strong>of</strong> article 14 are applicable mutatis mutandis. In additionto the information specified in paragraph 10 <strong>of</strong> article 14, requests made pursuant to<strong>this</strong> article shall contain the following:“(a) In the case <strong>of</strong> a request pertaining to subparagraph 1 (a) <strong>of</strong> <strong>this</strong> article, adescription <strong>of</strong> the property to be confiscated and a statement <strong>of</strong> the facts relied uponby the requesting State Party sufficient to enable the requested State Party to seekthe order under its domestic law;“(b) In the case <strong>of</strong> a request pertaining to subparagraph 1 (b) <strong>of</strong> <strong>this</strong> article, alegally admissible copy <strong>of</strong> an order <strong>of</strong> confiscation issued by the requesting StateParty upon which the request is based, a statement <strong>of</strong> the facts and information as tothe extent to which the execution <strong>of</strong> the order is requested;“(c) In the case <strong>of</strong> a request pertaining to paragraph 2 <strong>of</strong> <strong>this</strong> article, a statement<strong>of</strong> the facts relied upon by the requesting State Party and a description <strong>of</strong> theactions requested.“5. Each State Party shall furnish the Secretary-General with the text <strong>of</strong> any<strong>of</strong> its laws and regulations that give effect to <strong>this</strong> paragraph and the text <strong>of</strong> any subsequentchanges to such laws and regulations.“6. If a State Party elects to make the taking <strong>of</strong> the measures referred to inparagraphs 1 and 2 <strong>of</strong> <strong>this</strong> article conditional on the existence <strong>of</strong> a relevant treaty,that Party shall consider <strong>this</strong> Convention the necessary and sufficient treaty basis.“7. States Parties shall seek to conclude bilateral and multilateral treaties,agreements or arrangements to enhance the effectiveness <strong>of</strong> international cooperationpursuant to <strong>this</strong> article.“8. Cooperation under <strong>this</strong> article may be refused by a State Party if the <strong>of</strong>fenceto which the request relates would not be an <strong>of</strong>fence in the context <strong>of</strong> a criminalorganization if committed within its jurisdiction. 2“9. The provisions <strong>of</strong> <strong>this</strong> article shall not be construed to prejudice the rights<strong>of</strong> bona fide third parties.”Fifth session: 4-15 October 1999Notes by the Secretariat2. Delegations based their comments on the text <strong>of</strong> article 7 bis <strong>of</strong> the revised draftconvention contained in <strong>document</strong> A/AC.254/4/Rev.4, which was the same as that containedin <strong>document</strong> A/AC.254/4/Rev.3.2One delegation suggested that <strong>this</strong> paragraph should be clarified in respect <strong>of</strong> the phrase “an <strong>of</strong>fence in the context<strong>of</strong> a criminal organization”. Another delegation noted the need for further specification <strong>of</strong> grounds for refusal.
