Part One. Article 16 147Transmission <strong>of</strong> requests for extradition and any communication thereto shall beeffected between the authorities designated by the Parties. This requirement shall bewithout prejudice to the right <strong>of</strong> a Party to require that such requests and communicationsbe addressed to it through the diplomatic channel.“Option 2“1. With a view to facilitating cooperation within the framework <strong>of</strong> theConvention, States Parties shall establish central authorities, which shall communicatedirectly between themselves. The central authorities shall be responsible for handlingincoming and outgoing requests for extradition and mutual legal assistance.“2. [Notwithstanding paragraph 1,] States Parties, subject to their domestic legislation,shall consider simplifying extradition <strong>of</strong> consenting persons who waive formalextradition proceedings, by allowing direct transmission <strong>of</strong> extradition requestsbetween appropriate ministries and extraditing persons based only on warrants <strong>of</strong>arrests or judgements.“3. Any person regarding whom the measures referred to in paragraph 1 <strong>of</strong><strong>this</strong> article are being taken shall be entitled:“(a) To communicate with the nearest appropriate representative <strong>of</strong> the State <strong>of</strong>which that person is a national or which is otherwise entitled to establish such communicationor, if that person is a stateless person, the State in the territory <strong>of</strong> whichthat person habitually resides;“(b) To be visited by a representative <strong>of</strong> that State.“4. The rights referred to in paragraph 3 <strong>of</strong> <strong>this</strong> article shall be exercised inconformity with the laws and regulations <strong>of</strong> the State Party in the territory <strong>of</strong> whichthe <strong>of</strong>fender or the alleged <strong>of</strong>fender is present, subject to the provision that the saidlaws and regulations must enable full effect to be given to the purposes for whichthe rights accorded under paragraph 3 <strong>of</strong> <strong>this</strong> article are intended.”Rolling text (A/AC.254/4/Rev.1)“Article 10“Extradition 4“1. Each <strong>of</strong> the <strong>of</strong>fences to which <strong>this</strong> article applies shall be deemed to beincluded as an extraditable <strong>of</strong>fence in any extradition treaty existing between States4This article brings together articles 10 to 13 contained in <strong>document</strong> A/AC.254/4 and is based on a proposal submittedby France and Sweden (see A/AC.254/5) and resubmitted in an amended form during the first session <strong>of</strong> the Ad HocCommittee. The text in brackets in <strong>this</strong> article was proposed during the discussion at the first session <strong>of</strong> the Ad HocCommittee. One delegation noted that <strong>this</strong> article did not sufficiently take into account the principle <strong>of</strong> aut dedere aut judicare,in particular in respect <strong>of</strong> the establishment <strong>of</strong> jurisdiction. One delegation emphasized the importance <strong>of</strong> ensuring proceduralsafeguards and suggested that either a separate paragraph should deal with that issue or all relevant paragraphs shouldrefer to “fundamental legal principles”.5One delegation proposed that the scope <strong>of</strong> <strong>this</strong> article should be limited to <strong>of</strong>fences punishable by one year or more<strong>of</strong> imprisonment.
