For the purpose <strong>of</strong> subparagraphs 3 (d) and (e) <strong>of</strong> <strong>this</strong> article, theConference <strong>of</strong> the Parties shall acquire the necessary knowledge <strong>of</strong> the measures takenby States Parties in implementing <strong>this</strong> Convention and the difficulties encountered bythem in doing so through the information provided by the States Parties and throughthe promotion <strong>of</strong>, inter alia, meetings between national authorities and expert consultativeteams in accordance with the rules established by the Conference pursuant toparagraph 2 <strong>of</strong> <strong>this</strong> article.”Rolling text (A/AC.254/4/Rev.6)“Article 23“Conference <strong>of</strong> the Parties to the Convention 9“1. A Conference <strong>of</strong> the Parties to the Convention is hereby established toimprove the capacity <strong>of</strong> States Parties to combat transnational organized crime andto promote and monitor the implementation <strong>of</strong> the Convention.“2. The Conference <strong>of</strong> the Parties shall convene not later than one year followingthe entry into force <strong>of</strong> the Convention. The first task <strong>of</strong> the Conference willbe to agree upon and adopt rules <strong>of</strong> procedure and rules governing the activitiesdescribed in paragraphs 3 and 4 <strong>of</strong> <strong>this</strong> article (including rules concerning payment<strong>of</strong> expenses incurred in carrying out those activities).“3. The Conference <strong>of</strong> the Parties shall agree upon mechanisms for accomplishingthe objectives mentioned in paragraph 1 <strong>of</strong> <strong>this</strong> article, including: 10“(a) Facilitating activities by States Parties under articles 21 and 22 <strong>of</strong> <strong>this</strong>Convention, including by mobilizing voluntary contributions;“(b) Facilitating the exchange <strong>of</strong> information among States Parties on patterns andtrends in transnational organized crime and on successful practices for combating it;“(c) Cooperating with relevant international and non-governmental organizations;“(d) Examining periodically the implementation <strong>of</strong> the Convention by StatesParties;“(e) Making recommendations to improve the Convention and its implementation. 11“4. For the purpose <strong>of</strong> paragraphs 3 (d) and (e) <strong>of</strong> <strong>this</strong> article, the Conference<strong>of</strong> the Parties shall acquire the necessary knowledge <strong>of</strong> the measures taken by StatesParties in implementing <strong>this</strong> Convention and the difficulties encountered by them indoing so through the information provided by the States Parties and through the promotion<strong>of</strong>, inter alia, [meetings between national authorities 12 and expert consultativeteams] [to be established] 13 in accordance with the rules established by the Conferencepursuant to paragraph 2 <strong>of</strong> <strong>this</strong> article.” 149This article required further consideration, China stated that the new formulation <strong>of</strong> article 23 did not meet all itsconcerns.10Japan expressed concern about the confidentiality <strong>of</strong> some information foreseen under <strong>this</strong> paragraph and proposedinserting the following words: “taking into account the need for confidentiality <strong>of</strong> some information arising from the nature<strong>of</strong> the fight against transnational organized crime”. Other delegations were <strong>of</strong> the view that issues such as <strong>this</strong> could be leftto the conference <strong>of</strong> the parties, as they were too detailed to be dealt with in the convention.11The subparagraph making reference to “performing any other functions consistent with the Convention” as one <strong>of</strong>the objectives <strong>of</strong> the conference (included in both the proposals <strong>of</strong> Austria and the United States and <strong>of</strong> the working group),was deleted.12Spain proposed that reference should be made to central national authorities.13Proposal made by the Islamic Republic <strong>of</strong> Iran in an effort to achieve consensus.14During the discussions in the working group, concerns were expressed about how the conference <strong>of</strong> the parties wouldactually function. It was, therefore, deemed appropriate to begin identifying issues that would be covered by the rules thatthe conference would agree upon and adopt in accordance with paragraph 2.
