Each State Party shall give consideration to providing for the possibility<strong>of</strong>, in appropriate cases, mitigating punishment 15 <strong>of</strong> an accused person who providessubstantial cooperation in the investigation or prosecution <strong>of</strong> any <strong>of</strong> the <strong>of</strong>fences coveredby <strong>this</strong> Convention.“3. Each State Party shall give consideration to providing, in accordance withits fundamental legal principles, the possibility <strong>of</strong> granting immunity from prosecutionto a person who provides substantial cooperation in the investigation or prosecution<strong>of</strong> [any <strong>of</strong> the <strong>of</strong>fences established in articles [...] <strong>of</strong> <strong>this</strong> Convention] [an<strong>of</strong>fence covered by <strong>this</strong> Convention].“4. Protection <strong>of</strong> such persons shall be as provided for in article 18 <strong>of</strong> <strong>this</strong>Convention.“5. Where a person referred to in paragraph 1 <strong>of</strong> <strong>this</strong> article can provide substantialcooperation to the competent authorities <strong>of</strong> another State, the States Partiesconcerned may consider entering into arrangements, in accordance with domestic law,concerning the potential provision by the other State <strong>of</strong> the treatment described inparagraphs 2 and 3 <strong>of</strong> <strong>this</strong> article.”Notes by the Secretariat3. At its eighth session, the Ad Hoc Committee provisionally approved article 18 ter,subject to the resolution <strong>of</strong> some issues that would need to be discussed in the light <strong>of</strong> thefinalization <strong>of</strong> other provisions <strong>of</strong> the convention, in particular article 2 (see A/AC.254/28,para. 12). At its tenth session, the Ad Hoc Committee considered, finalized and approvedarticle 18 ter, as amended. The last amendments are reflected in the final text <strong>of</strong> the convention,as included in the report <strong>of</strong> the Ad Hoc Committee (see A/55/383, sect. IV, draftresolution, annex I), that was submitted to the General Assembly for adoption pursuant toresolution 54/126 <strong>of</strong> 17 December 1999.14At the eighth session <strong>of</strong> the Ad Hoc Committee, Turkey reserved its position on the use <strong>of</strong> the term “organizedcriminal groups” until the finalization <strong>of</strong> article 2 bis <strong>of</strong> the draft convention.15This phrase might include not only prescribed but also de facto mitigation <strong>of</strong> punishment (see the interpretative notein section C below).
