Part One. Article 16 159“9. States Parties shall, subject to their domestic laws, endeavour to expediteextradition procedures and to simplify evidentiary requirements relating thereto inrespect <strong>of</strong> any <strong>of</strong>fence to which <strong>this</strong> article applies.“10. Subject to the provisions <strong>of</strong> its domestic law and its extradition treaties,the requested State Party may, upon being satisfied that the circumstances so warrantand are urgent and at the request <strong>of</strong> the requesting Party, take a person whose extraditionis sought and who is present in its territory into custody or take other appropriatemeasures to ensure his or her presence at extradition proceedings.“11. [(a) Without prejudice to the exercise <strong>of</strong> any criminal jurisdiction establishedin accordance with its domestic law, a State Party in whose territory an alleged<strong>of</strong>fender is found shall, if it does not extradite him or her in respect <strong>of</strong> an <strong>of</strong>fenceestablished in accordance with articles 3, 4, 4 ter or 17 bis <strong>of</strong> <strong>this</strong> Convention and aserious crime involving an organized criminal group and has established its jurisdictionover the <strong>of</strong>fence in accordance with paragraph 3 or 4 <strong>of</strong> article 9 <strong>of</strong> <strong>this</strong>Convention, be obliged, at the request <strong>of</strong> the State Party seeking extradition, to submitthe case without undue delay to its competent authorities for the purpose <strong>of</strong> prosecutionthrough proceedings in accordance with the laws <strong>of</strong> the State where the<strong>of</strong>fender is found;]“Option 1“[(a bis) The States Parties concerned shall cooperate with each other, in particularon procedural and evidentiary aspects, to ensure the efficiency <strong>of</strong> such prosecution;]“Option 2“[(a bis) A State Party that submits a case for prosecution following the denial<strong>of</strong> extradition on grounds <strong>of</strong> nationality shall treat the investigation and prosecutionwith diligence, shall devote sufficient resources to conduct the matter effectively andshall coordinate the matter with the requesting State. It shall ensure that its mutualassistance, procedural and evidentiary laws enable effective action to be taken on thebasis <strong>of</strong> evidence obtained from another State;]“(b) Whenever a State Party is permitted under its domestic law to extradite orotherwise surrender one <strong>of</strong> its nationals only upon the condition that the person willbe returned to that State to serve the sentence imposed as a result <strong>of</strong> the trial or proceedingsfor which the extradition or surrender <strong>of</strong> the person was sought and <strong>this</strong> Stateand the State seeking the extradition <strong>of</strong> the person agree with <strong>this</strong> option and otherterms that they may deem appropriate, such a conditional extradition or surrender shallbe sufficient to discharge the obligation set forth in subparagraph (a) <strong>of</strong> <strong>this</strong> paragraph.“12. If extradition, sought for purposes <strong>of</strong> enforcing a sentence, is refusedbecause the person sought is a national <strong>of</strong> the requested State Party, the requestedParty shall, if its law so permits and if it is in conformity with the requirement <strong>of</strong>such law, upon application <strong>of</strong> the requesting Party, consider the enforcement <strong>of</strong> thesentence that has been imposed under the law <strong>of</strong> the requesting Party or the remainderthere<strong>of</strong>.“13. Any person regarding whom proceedings are being carried out in connectionwith any <strong>of</strong> the <strong>of</strong>fences covered by <strong>this</strong> Convention shall be guaranteed fairtreatment at all stages <strong>of</strong> the proceedings, including enjoyment <strong>of</strong> all the rights and
