Each State Party may also take such measures as may be necessary toestablish its jurisdiction over the <strong>of</strong>fences covered by <strong>this</strong> Convention when thealleged <strong>of</strong>fender is present in its territory and it does not extradite him or her.“5. If the State exercising its jurisdiction under paragraph 1 or 2 <strong>of</strong> <strong>this</strong> articlehas been notified, or has otherwise learned, that one or more other States are conductingan investigation or carrying out criminal proceedings in respect <strong>of</strong> the sameconduct, the competent authorities <strong>of</strong> those States shall, as appropriate, consult oneanother with a view to coordinating their actions.“6. Without prejudice to norms <strong>of</strong> general international law, <strong>this</strong> Conventiondoes not exclude the exercise <strong>of</strong> any criminal jurisdiction established by a State Partyin accordance with its domestic law.[Paragraph 7 was deleted.]”Notes by the Secretariat3. At its tenth session, the Ad Hoc Committee considered, finalized and approvedarticle 9, as last amended. The inclusion in subparagraph 2 (b) <strong>of</strong> the phrase “or (by) astateless person who has his or her habitual residence in its territory” was proposed byBelgium and approved. The last amendments are reflected in the final text <strong>of</strong> the convention,as included in the report <strong>of</strong> the Ad Hoc Committee (A/55/383, sect. IV, draft resolution,annex I), that was submitted to the General Assembly for adoption pursuant toresolution 54/126 <strong>of</strong> 17 December 1999.B. Approved text adopted by the General Assembly(see resolution 55/25, annex I)Article 15Jurisdiction1. Each State Party shall adopt such measures as may be necessary toestablish its jurisdiction over the <strong>of</strong>fences established in accordance with articles5, 6, 8 and 23 <strong>of</strong> <strong>this</strong> Convention when:(a) The <strong>of</strong>fence is committed in the territory <strong>of</strong> that State Party; or(b) The <strong>of</strong>fence is committed on board a vessel that is flying the flag <strong>of</strong>that State Party or an aircraft that is registered under the laws <strong>of</strong> that State Partyat the time that the <strong>of</strong>fence is committed.2. Subject to article 4 <strong>of</strong> <strong>this</strong> Convention, a State Party may also establishits jurisdiction over any such <strong>of</strong>fence when:(a) The <strong>of</strong>fence is committed against a national <strong>of</strong> that State Party;(b) The <strong>of</strong>fence is committed by a national <strong>of</strong> that State Party or a statelessperson who has his or her habitual residence in its territory; or(c) The <strong>of</strong>fence is:(i) One <strong>of</strong> those established in accordance with article 5, paragraph 1, <strong>of</strong><strong>this</strong> Convention and is committed outside its territory with a view to thecommission <strong>of</strong> a serious crime within its territory;
