186 Travaux préparatoires: United Nations Convention against Transnational Organized Crimetion, prosecution or judicial proceeding in the territory <strong>of</strong> the requesting Party shallnot be prosecuted, detained, punished or subjected to any other restriction <strong>of</strong> his orher personal liberty in that territory in respect <strong>of</strong> acts, omissions or convictions priorto his or her departure from the territory <strong>of</strong> the requested State Party. Such safe conductshall cease when the witness, expert or other person having had, for a period <strong>of</strong>fifteen consecutive days, or for any period agreed upon by the Parties, from the dateon which he or she has been <strong>of</strong>ficially informed that his or her presence is no longerrequired by the judicial authorities, an opportunity <strong>of</strong> leaving, has neverthelessremained voluntarily in the territory <strong>of</strong> the requesting Party or, having left it, hasreturned <strong>of</strong> his or her own free will.“20 bis. The authorities <strong>of</strong> the requested State Party may request to be presentin proceedings conducted in the territory <strong>of</strong> the requesting State Party. 70“21. The ordinary costs <strong>of</strong> executing a request shall be borne by the requestedState Party, unless otherwise agreed by the Parties concerned. If expenses <strong>of</strong> a substantialor extraordinary nature are or will be required to fulfil the request, the Partiesshall consult to determine the terms and conditions under which the request will beexecuted, as well as the manner in which the costs shall be borne. 71“21 bis. (a) The requested State Party shall provide copies <strong>of</strong> governmentrecords, <strong>document</strong>s or information in its possession that, under its laws, are availableto the general public;“(b) The requested State Party may, at its discretion, provide in whole, in partor subject to such conditions as it deems appropriate, copies <strong>of</strong> any governmentrecords, <strong>document</strong>s or information in its possession that under its laws are not availableto the general public. 72“22. States Parties shall consider, as may be necessary, the possibility <strong>of</strong> concludingbilateral or multilateral agreements or arrangements that would serve the purposes<strong>of</strong>, give practical effect to or enhance the provisions <strong>of</strong> <strong>this</strong> article.”Tenth session: 17-28 July 2000Notes by the Secretariat2. The <strong>version</strong> <strong>of</strong> article 14 contained in <strong>document</strong> A/AC.254/4/Rev.5 remainedunchanged in the intermediate drafts <strong>of</strong> the Convention (A/AC.254/4/Revs.6-9 and Corr.1).The only changes in <strong>document</strong>s A/AC.254/4/Rev.8 and A/AC.254/4/Rev.9 were the renumbering<strong>of</strong> paragraphs and subparagraphs and an editorial redrafting <strong>of</strong> paragraph 5 (d). Thedraft text <strong>of</strong> the article, on which delegations based their comments at the tenth session <strong>of</strong>the Ad Hoc Committee, was as follows:70This paragraph was proposed by Mexico. It was originally contained in <strong>document</strong> A/AC.254/L.44 and is presentedhere as further amended by Mexico at the fifth session <strong>of</strong> the Ad Hoc Committee.71One delegation noted that the wording <strong>of</strong> <strong>this</strong> paragraph required clarification. Bangladesh suggested that the modalitiesfor sharing ordinary costs <strong>of</strong> executing the request should be decided through mutual consultation between the requestingState party and the requested State party.72This provision, based on a proposal submitted by the United States at the fourth session <strong>of</strong> the Ad Hoc Committee(see A/AC.254/L.33), was redrafted following a preliminary discussion at the fifth session <strong>of</strong> the Ad Hoc Committee. Itwould require further examination.
