States Parties shall take measures conducive to the optimal implementation<strong>of</strong> <strong>this</strong> Convention to the extent possible, through international cooperation, takinginto account the negative effects <strong>of</strong> organized crime on sustainable development.“2. States Parties shall make concrete efforts to the extent <strong>of</strong> their capacitiesand in coordination with the international agencies:“(a) To enhance their cooperation at various levels with developing countries,with a view to strengthening the capacity <strong>of</strong> the latter to combat, eradicate and preventtransnational organized crime;“(b) To provide more constructive opportunities for the sustainable economicdevelopment <strong>of</strong> developing countries. This will require financial and material assistanceto prepare developing countries to fight transnational organized crime effectivelyand to help them implement the Convention successfully;“(c) To establish a special United Nations fund for technical cooperation inorder to provide technical assistance to developing countries and countries witheconomies in transition to assist them in meeting their needs for the implementation<strong>of</strong> <strong>this</strong> Convention. States Parties shall endeavour to make adequate and regularvoluntary contributions to the fund. States Parties shall also consider, in accordancewith their domestic legislation and the provisions <strong>of</strong> <strong>this</strong> Convention, contributing tothe fund a percentage <strong>of</strong> the money or <strong>of</strong> the corresponding value <strong>of</strong> illicit assetsconfiscated in accordance with the provisions <strong>of</strong> <strong>this</strong> Convention;1The text <strong>of</strong> <strong>this</strong> article was presented at the sixth session <strong>of</strong> the Ad Hoc Committee by India on behalf <strong>of</strong> the Group<strong>of</strong> 77 (A/AC.254/L.108). During the preliminary discussion that ensued, there was support for many <strong>of</strong> the principles embodiedin the article. Several proposals were made regarding the best way <strong>of</strong> articulating those principles, including consideringthe matter in connection with articles 21 and 23.257
