18 Travaux préparatoires: United Nations Convention against Transnational Organized CrimeSubparagraph (f)(d) The terms “freezing” or “seizure” as defined in article 2, subparagraph(f), can be found in articles 12 and 13 <strong>of</strong> the United Nations Convention againstTransnational Organized Crime. The term “search and seizure” appearing in article18 should not be confused with “seizure” in article 2. “Search and seizure”refers to the use <strong>of</strong> intrusive compulsory measures by law enforcement authoritiesto obtain evidence for purposes <strong>of</strong> a criminal case. The term “freezing” inarticle 18 is used to cover the concept defined as “freezing” or “seizure” in article2 and should be understood more broadly to include not only property butalso evidence.Subparagraph (g)(e) When the domestic law <strong>of</strong> a State party requires the order <strong>of</strong> a courtfor confiscation, that court will be considered the only competent authority for thepurposes <strong>of</strong> <strong>this</strong> definition.
