At its tenth session, the Ad Hoc Committee considered, finalized and approvedarticle 25, as amended. The last amendments are reflected in the final text <strong>of</strong> the convention,as included in the report <strong>of</strong> the Ad Hoc Committee (A/55/383, sect. IV, draft resolution,annex I), that was submitted to the General Assembly for adoption pursuant toresolution 54/126 <strong>of</strong> 17 December 1999.B. Approved text adopted by the General Assembly(see resolution 55/25, annex I)Article 35Settlement <strong>of</strong> disputesl. States Parties shall endeavour to settle disputes concerning the interpretationor application <strong>of</strong> <strong>this</strong> Convention through negotiation.2. Any dispute between two or more States Parties concerning the interpretationor application <strong>of</strong> <strong>this</strong> Convention that cannot be settled through negotiationwithin a reasonable time shall, at the request <strong>of</strong> one <strong>of</strong> those States Parties,be submitted to arbitration. If, six months after the date <strong>of</strong> the request for arbitration,those States Parties are unable to agree on the organization <strong>of</strong> the arbitration,any one <strong>of</strong> those States Parties may refer the dispute to the <strong>International</strong>Court <strong>of</strong> Justice by request in accordance with the Statute <strong>of</strong> the Court.3. Each State Party may, at the time <strong>of</strong> signature, ratification, acceptanceor approval <strong>of</strong> or accession to <strong>this</strong> Convention, declare that it does not consideritself bound by paragraph 2 <strong>of</strong> <strong>this</strong> article. The other States Parties shall not bebound by paragraph 2 <strong>of</strong> <strong>this</strong> article with respect to any State Party that has madesuch a reservation.4. Any State Party that has made a reservation in accordance with paragraph3 <strong>of</strong> <strong>this</strong> article may at any time withdraw that reservation by notificationto the Secretary-General <strong>of</strong> the United Nations.C. Interpretative noteThe interpretative note on article 35 <strong>of</strong> the convention approved by the AdHoc Committee and contained in its report on the work <strong>of</strong> its first to eleventhsessions (see A/55/383/Add.1, para. 60) is as follows:Paragraph 1The term “negotiation” is to be understood in a broad sense to indicate anencouragement to States to exhaust all avenues <strong>of</strong> peaceful settlement <strong>of</strong> disputes,including conciliation, mediation and recourse to regional bodies.
