Each State Party shall adopt such legislative and other measures as maybe necessary to establish as offences under its domestic law, when committed intentionally:“(a) The conversion or transfer of property, knowing that such property is theproceeds of crime, for the purpose of concealing or disguising the illicit origin of theproperty or of assisting any person who is involved in the commission of the predicateoffence to evade the legal consequences of his or her actions;“(b) The concealment or disguise of the true nature, source, location, disposition,movement, rights with respect to or ownership of property, knowing that suchproperty is the proceeds of crime; and, subject to its constitutional principles andbasic concepts of its legal system;“(c) The acquisition, possession or use of property, knowing, at the time ofreceipt, that such property was the proceeds of crime;“(d) Participation in, association with or conspiracy to commit, attempts to commitand aiding, abetting, facilitating and counselling the commission of any of theoffences established in accordance with this article.“Option 2 5“1. Each State Party shall adopt such legislative and other measures as may benecessary to establish as offences under its domestic law, when committed intentionally:“(a) The acquisition, disposal, administration, safe-keeping, exchange, deposit,guaranteeing, investment, transport, possession, granting or transfer of funds, rightsor property of any kind, knowing that such funds, rights or property are derived from,or represent the proceeds of, crime, for the purpose of concealing, disguising or preventingthe discovery of the illicit origin thereof or of assisting any person who isinvolved in the commission of the predicate offence to evade the legal consequencesof his or her actions;“(b) The concealment or attempted concealment, disguise or prevention of the discoveryof the origin, destination, ownership, true nature, source, location, disposition,movement or rights with respect to funds, rights or property of any kind, knowing thatsuch funds, rights or property are derived from, or represent the proceeds of, crime;“(c) The possession or use of funds, rights or property of any kind, knowing,at the time of receipt or subsequently, that such funds, rights or property are derivedfrom, or represent the proceeds of, crime;“(d) Participation in, association with or conspiracy to commit, attempting tocommit and aiding, abetting, facilitating and counselling the commission of any ofthe offences established in accordance with this article.3This article was to be considered by the Ad Hoc Committee at its third session.4See footnote 1 above.5Option 2 was based on a proposal submitted by Mexico (see A/AC.254/L.7).
