The <strong>version</strong> <strong>of</strong> article 10 contained in <strong>document</strong> A/AC.254/4/Rev.5 remainedunchanged in the intermediate drafts <strong>of</strong> the convention (A/AC.254/4/Revs.6 and 7).China (A/AC.254/L.181)China suggested that paragraph 3 <strong>of</strong> article 10 should be replaced with thefollowing:“3. If a State Party that makes extradition conditional on the existence <strong>of</strong> atreaty receives a request for extradition from another State Party with which it hasno extradition treaty, it may consider <strong>this</strong> Convention the legal basis for extraditionin respect <strong>of</strong> any <strong>of</strong>fence to which <strong>this</strong> article applies.“(...) States Parties that make extradition conditional on the existence <strong>of</strong> a treatyshall:“(a) Inform the Secretary-General <strong>of</strong> the United Nations <strong>of</strong> whether they willtake <strong>this</strong> Convention as the legal basis for cooperation on extradition with other StatesParties to <strong>this</strong> Convention;“(b) Endeavour to conclude treaties on extradition with other States Parties to<strong>this</strong> Convention in order to implement <strong>this</strong> article.”Rolling text (A/AC.254/4/Rev.8 )“Article 10 34“Extradition“1. If the request for extradition includes several separate serious crimes, but<strong>of</strong> which some are other than those covered by <strong>this</strong> Convention, the requested Partymay apply <strong>this</strong> article also in respect <strong>of</strong> the latter <strong>of</strong>fences.] 3634Part <strong>of</strong> the text <strong>of</strong> <strong>this</strong> article was revised at the informal consultations held during the eighth session <strong>of</strong> the Ad HocCommittee and was recommended by the Chairmen <strong>of</strong> those informal consultations to the Ad Hoc Committee for considerationat its ninth session.35Following extensive discussion during the informal consultations held at the eighth session <strong>of</strong> the Ad Hoc Committeeand pursuant to a proposal made by China (A/AC.254/L.182), it was agreed to incorporate the principle <strong>of</strong> dual criminalityin <strong>this</strong> paragraph and to amend paragraph 7 to ensure that minor <strong>of</strong>fences were not considered extraditable.36At the informal consultations held during the eighth session <strong>of</strong> the Ad Hoc Committee, some delegations expressedconcern about the scope <strong>of</strong> <strong>this</strong> paragraph and suggested that it should be deleted.
