If a State Party that makes extradition conditional on the existence of atreaty receives a request for extradition from another State Party with which it hasno extradition treaty, it may consider this Convention the legal basis for extraditionin respect of any offence to which this article applies.“(...) If the request for extradition includes several separate serious crimes, butof which some are other than those covered by this Convention, the requested Partymay apply this article also in respect of the latter offences.] 3634Part of the text of this article was revised at the informal consultations held during the eighth session of the Ad HocCommittee and was recommended by the Chairmen of those informal consultations to the Ad Hoc Committee for considerationat its ninth session.35Following extensive discussion during the informal consultations held at the eighth session of the Ad Hoc Committeeand pursuant to a proposal made by China (A/AC.254/L.182), it was agreed to incorporate the principle of dual criminalityin this paragraph and to amend paragraph 7 to ensure that minor offences were not considered extraditable.36At the informal consultations held during the eighth session of the Ad Hoc Committee, some delegations expressedconcern about the scope of this paragraph and suggested that it should be deleted.
