Article 6 373including, in appropriate cases, in cooperation with non-governmental organizations,other relevant organizations and other elements <strong>of</strong> civil society, and, inparticular, the provision <strong>of</strong>:(a) Appropriate housing;(b) Counselling and information, in particular as regards their legal rights,in a language that the victims <strong>of</strong> trafficking in persons can understand;(c) Medical, psychological and material assistance; and(d) Employment, educational and training opportunities.4. Each State Party shall take into account, in applying the provisions <strong>of</strong><strong>this</strong> article, the age, gender and special needs <strong>of</strong> victims <strong>of</strong> trafficking in persons,in particular the special needs <strong>of</strong> children, including appropriate housing, educationand care.5. Each State Party shall endeavour to provide for the physical safety <strong>of</strong>victims <strong>of</strong> trafficking in persons while they are within its territory.6. Each State Party shall ensure that its domestic legal system containsmeasures that <strong>of</strong>fer victims <strong>of</strong> trafficking in persons the possibility <strong>of</strong> obtainingcompensation for damage suffered.C. Interpretative noteThe interpretative note on article 6 <strong>of</strong> the protocol approved by the Ad HocCommittee and contained in its report on the work <strong>of</strong> its first to eleventh sessions(see A/55/383/Add.1, para. 71) is as follows:Paragraph 3The type <strong>of</strong> assistance set forth in <strong>this</strong> paragraph is applicable to both thereceiving State and the State <strong>of</strong> origin <strong>of</strong> the victims <strong>of</strong> trafficking in persons, butonly as regards victims who are in their respective territory. Paragraph 3 is applicableto the receiving State until the victim <strong>of</strong> trafficking in persons has returnedto his or her State <strong>of</strong> origin, and to the State <strong>of</strong> origin thereafter.Notes by the Secretariat6. A separate article (article 7, on victim rehabilitation) was also discussed in the context<strong>of</strong> the negotiation process. It was included in the first drafts <strong>of</strong> the protocol, but wasnot finally incorporated as a separate provision in the restructured <strong>version</strong> <strong>of</strong> the protocolthat was proposed as a result <strong>of</strong> the informal consultations held during the fifth session <strong>of</strong>the Ad Hoc Committee. However, as indicated above (see note 4 by the Secretariat concerningarticle 37 <strong>of</strong> the convention in part one), the objective <strong>of</strong> the present publication isto present a complete picture <strong>of</strong> the negotiations on the content <strong>of</strong> the convention and itsprotocols, irrespective <strong>of</strong> which provisions were finally included in the approved texts. For<strong>this</strong> reason, it has been considered appropriate to provide the following presentation <strong>of</strong> therelevant drafts <strong>of</strong> article 7 and the discussions on its content that had taken place beforethe informal consultations held during the fifth session <strong>of</strong> the Ad Hoc Committee.
