At its twelfth session, the Ad Hoc Committee considered, finalized and approvedarticle 4 <strong>of</strong> the draft protocol, as amended on the basis <strong>of</strong> the recommendations <strong>of</strong> theinformal working group (in respect <strong>of</strong> paragraph 1) and the proposal made by the Chairman(in respect <strong>of</strong> paragraph 2). The last amendments are reflected in the final text <strong>of</strong> the protocol,as included in the report <strong>of</strong> the Ad Hoc Committee (A/55/383/Add.2, sect. III, draftresolution, annex), that was submitted to the General Assembly for adoption pursuant toresolutions 54/126 <strong>of</strong> 17 December 1999 and 55/25 <strong>of</strong> 15 November 2000.7. The representatives <strong>of</strong> Chile and Mexico requested that the report <strong>of</strong> the Ad HocCommittee on its twelfth session should indicate that their Governments had not participatedin the decision <strong>of</strong> the Ad Hoc Committee on article 4, paragraph 2, <strong>of</strong> the draft protocol,but had not stood in the way <strong>of</strong> consensus. The representative <strong>of</strong> Colombia requestedthat the report <strong>of</strong> the Ad Hoc Committee on its twelfth session should reflect hisGovernment’s position on article 4, paragraph 2, <strong>of</strong> the draft protocol, namely, that it considereditself not to be bound by the decision <strong>of</strong> the Ad Hoc Committee on that provision.The representatives <strong>of</strong> Benin and Nigeria requested that the report <strong>of</strong> the Ad Hoc Committeeon its twelfth session should indicate their reservations on article 4, paragraph 2, <strong>of</strong> thedraft protocol, because <strong>of</strong> the exclusion <strong>of</strong> state-to-state transactions and state transfers.The representative <strong>of</strong> Ukraine requested that the report <strong>of</strong> the Ad Hoc Committee on itstwelfth session should reflect his view that the words “state-to-state transactions” and “statetransfers” were included in article 4, paragraph 2, on the understanding that they includedstate-to-state transactions involving firearms and State transfers <strong>of</strong> firearms effected onthe basis <strong>of</strong> relevant agreements concluded between the Governments <strong>of</strong> the States concernedor on behalf <strong>of</strong> those Governments by virtue <strong>of</strong> powers conferred by them. Therepresentative <strong>of</strong> Azerbaijan requested that the report <strong>of</strong> the Ad Hoc Committee on itstwelfth session should indicate that his Government had reserved its right to make reservationsregarding article 4, paragraph 2, <strong>of</strong> the draft protocol. The representative <strong>of</strong> theSyrian Arab Republic requested that the report <strong>of</strong> the Ad Hoc Committee on its twelfthsession should reflect his Government’s reservations regarding article 4 <strong>of</strong> the draft protocol.The representative <strong>of</strong> the Libyan Arab Jamahiriya requested that the report <strong>of</strong> theAd Hoc Committee on its twelfth session should reflect his Government’s reservationsregarding the retention <strong>of</strong> article 4, paragraph 2 <strong>of</strong> the draft protocol. The representative<strong>of</strong> China requested that the report <strong>of</strong> the Ad Hoc Committee on its twelfth session shouldindicate his Government’s reservation on article 4 <strong>of</strong> the draft protocol, namely, that theprotocol should not apply to state-to-state transactions. The representative <strong>of</strong> India requestedthat the report <strong>of</strong> the Ad Hoc Committee on its twelfth session should reflect hisGovernment’s position on article 4, paragraph 2. In the view <strong>of</strong> that representative, theexclusions foreseen in that paragraph would be viewed only in narrow, precisely definedterms. His Government would enter a reservation to that effect at the time <strong>of</strong> signature <strong>of</strong>the protocol.
