348 Travaux préparatoires: United Nations Convention against Transnational Organized CrimeSubparagraph (b)(e) This subparagraph should not be interpreted as restricting the applicationof mutual legal assistance in accordance with article 18 of the convention.(f) Subparagraph (b) should not be interpreted as imposing any restrictionon the right of accused persons to a full defence and to the presumption ofinnocence. It should also not be interpreted as imposing on the victim the burdenof proof. As in any criminal case, the burden of proof is on the State or publicprosecutor, in accordance with domestic law. Further, reference should be madeto article 11, paragraph 6, of the convention, which preserves applicable legaldefences and other related principles of the domestic law of States parties.
