348 Travaux préparatoires: United Nations Convention against Transnational Organized CrimeSubparagraph (b)(e) This subparagraph should not be interpreted as restricting the application<strong>of</strong> mutual legal assistance in accordance with article 18 <strong>of</strong> the convention.(f) Subparagraph (b) should not be interpreted as imposing any restrictionon the right <strong>of</strong> accused persons to a full defence and to the presumption <strong>of</strong>innocence. It should also not be interpreted as imposing on the victim the burden<strong>of</strong> pro<strong>of</strong>. As in any criminal case, the burden <strong>of</strong> pro<strong>of</strong> is on the State or publicprosecutor, in accordance with domestic law. Further, reference should be madeto article 11, paragraph 6, <strong>of</strong> the convention, which preserves applicable legaldefences and other related principles <strong>of</strong> the domestic law <strong>of</strong> States parties.
