During the informal consultations held during the eighth session <strong>of</strong> the Ad HocCommittee, it was noted that the text <strong>of</strong> <strong>this</strong> article was substantially similar to article 2,paragraphs 3 and 4, <strong>of</strong> the draft convention and that the Ad Hoc Committee had decidedin principle to make such provisions <strong>of</strong> the draft convention applicable to the draft protocols,mutatis mutandis. Pending a decision <strong>of</strong> the Ad Hoc Committee on the exact means<strong>of</strong> doing <strong>this</strong>, however, language had not been adopted for the draft convention and theinformal consultations therefore recommended retention <strong>of</strong> article 4 bis for further considerationonce language had been adopted in the draft convention.5. At the eleventh session <strong>of</strong> the Ad Hoc Committee, many delegations recognizedthe importance <strong>of</strong> the issues reflected in the proposal, but were <strong>of</strong> the view that thoseissues should not be dealt with in the protocol. The Vice Chairman proposed that thetext <strong>of</strong> the article should be moved to the preamble and requested delegations thatsupported its retention to develop text to be included in the preamble based on thepresent language.7. At the twelfth session <strong>of</strong> the Ad Hoc Committee, the Chairman proposed the deletion<strong>of</strong> the article (see A/AC.254/L.281, para. 4). The text <strong>of</strong> the article was further developedand incorporated in the preamble <strong>of</strong> the protocol.
