The informal working group proposes to continue work on article 2 on thebasis of the following text:‘Article 2‘Definitions‘For the purposes of this Protocol,‘(a) “Smuggling of migrants” shall mean the procurement, in order toobtain, directly or indirectly, a financial or other material benefit, of the illegalentry of a person into a State Party of which the person is not a national or apermanent resident;‘(b) “Illegal entry” shall mean the crossing of borders without complyingwith the necessary requirements for legal entry into the receiving State.’“2. The words ‘or illegal residence’ should be deleted from subparagraph (a).“3. Subparagraph (c) should be deleted.”Notes by the Secretariat4. At its eleventh session, the Ad Hoc Committee considered, finalized and approvedarticle 2, as amended. The definition of “vehicle” was deleted. The last amendments arereflected in the final text of the protocol, as included in the report of the Ad Hoc Committee(A/55/383, sect. IV, draft resolution, annex III), that was submitted to the General Assemblyfor adoption pursuant to resolution 54/126 of 17 December 1999.B.
