Interpretative noteThe interpretative note on article 8 <strong>of</strong> the protocol approved by the Ad HocCommittee and contained in its report on the work <strong>of</strong> its first to eleventh sessions(see A/55/383/Add.1, para. 100) is as follows:The word “engaged” in paragraphs 1, 2 and 7 <strong>of</strong> <strong>this</strong> article and in paragraph1 <strong>of</strong> article 10 should be understood broadly as including vessels “engaged”both directly and indirectly in the smuggling <strong>of</strong> migrants. Of particular concernwas the inclusion <strong>of</strong> both vessels actually found to be carrying smuggled migrantsand vessels (“mother ships”) that transport smuggled migrants on open ocean voyagesbut are sometimes not apprehended until after the migrants have been transferredto smaller local vessels for landing purposes.Notes by the Secretariat6.
