594 Travaux préparatoires: United Nations Convention against Transnational Organized Crime“Recalling also General Assembly resolutions 54/54 V <strong>of</strong> 15 December 1999,entitled “Small arms”, in which the Assembly, inter alia, reaffirmed the inherent rightto individual or collective self-defence recognized in article 51 <strong>of</strong> the Charter <strong>of</strong> theUnited Nations, which implied that States also had the right to acquire arms withwhich to defend themselves, as well as the right <strong>of</strong> self-determination <strong>of</strong> all peoples,in particular, peoples under colonial or other forms <strong>of</strong> alien domination or foreignoccupation, and the importance <strong>of</strong> the effective realization <strong>of</strong> that right, as enunciated,inter alia, in the Vienna Declaration and Programme <strong>of</strong> Action, adopted by theWorld Conference on Human Rights on 25 June 1993, and 55/33 Q <strong>of</strong> 20 November2000, entitled “Illicit traffic in small arms and light weapons”,“Convinced that supplementing the United Nations Convention againstTransnational Organized Crime with an international instrument against the illicitmanufacturing <strong>of</strong> and trafficking in firearms, their parts and components and ammunitionwill be useful in preventing and combating those crimes,“Have agreed as follows:”Notes by the Secretariat4. At its twelfth session, the Ad Hoc Committee considered, finalized and approvedthe preamble <strong>of</strong> the draft Protocol, as amended. Former article O <strong>of</strong> the draft Protocol wasmoved, as amended, to the preamble (see also note 7 by the Secretariat in the chapter ondeleted articles below). The last amendments are reflected in the final text <strong>of</strong> the protocol,as included in the report <strong>of</strong> the Ad Hoc Committee (A/55/383/Add.2, sect. III, draftresolution, annex), that was submitted to the General Assembly for adoption pursuant toresolutions 54/126 <strong>of</strong> 17 December 1999 and 55/25 <strong>of</strong> 15 November 2000).5. It should be noted that the representative <strong>of</strong> Argentina reserved his Government’sposition on including in the preamble <strong>of</strong> the draft protocol a reference to the Declarationon Principles <strong>of</strong> <strong>International</strong> <strong>La</strong>w concerning Friendly Relations and Cooperation amongStates in accordance with the Charter <strong>of</strong> the United Nations (General Assembly resolution2625 (XXV), annex). The inclusion <strong>of</strong> that reference entailed a partial redefinition <strong>of</strong> thescope and extent <strong>of</strong> the principle <strong>of</strong> self-determination <strong>of</strong> peoples, which had been the subject<strong>of</strong> other resolutions <strong>of</strong> the Assembly, such as resolution 1514 (XV) <strong>of</strong> 14 December1960. Furthermore, he was <strong>of</strong> the view that it was not appropriate to include such a referencein an international instrument whose principal objective was to fight the illicit manufacturing<strong>of</strong> and trafficking in firearms, their parts and components and ammunition. Hestated that the Government <strong>of</strong> Argentina reserved its right to reiterate its position whenthe matter was considered by the Assembly or at the time <strong>of</strong> signature or ratification <strong>of</strong>the protocol.
