States Parties shall carry out their obligations under <strong>this</strong> Convention in amanner consistent with the principles <strong>of</strong> sovereign equality and territorial integrity <strong>of</strong>States and that <strong>of</strong> non-intervention in the domestic affairs <strong>of</strong> other States.“Exclusive exercise <strong>of</strong> jurisdiction and performance <strong>of</strong> functions“7. A State Party shall not undertake in the territory <strong>of</strong> another State the exercise<strong>of</strong> jurisdiction and performance <strong>of</strong> functions that are exclusively reserved for theauthorities <strong>of</strong> that other State by its domestic law.“Protocols“8. The Convention shall apply to the prevention, investigation and prosecution<strong>of</strong> <strong>of</strong>fences referred to herein involving a transnational organized criminal group.“2. Among the circumstances that may be taken into account in establishingwhether a criminal organization is involved in any <strong>of</strong> the <strong>of</strong>fences covered by <strong>this</strong>Convention are the following:“(a)“(b)“(c)The transnational character <strong>of</strong> the <strong>of</strong>fence;The perpetration <strong>of</strong> acts <strong>of</strong> money-laundering;The means used for its preparation, execution, commission or completion.“3. The Convention shall apply, inter alia, to the following <strong>of</strong>fences: (indicativelist <strong>of</strong> <strong>of</strong>fences).18In connection with the consideration <strong>of</strong> the protocols, there was considerable discussion <strong>of</strong> the link between the protocolsand the convention. Australia made a proposal to the effect that a State party to one <strong>of</strong> the protocols must also be aparty to the convention and that a State party to the convention should not be bound by a protocol unless the party hadexpressly accepted the protocol (see A/AC.254/L.9). Two delegations proposed the deletion <strong>of</strong> paragraph 8.
