Interpretative notesThe interpretative notes on article 23 of the convention approved by the AdHoc Committee and contained in its report on the work of its first to eleventhsessions (see A/55/383/Add.1, paras. 46 and 47) are as follows:Subparagraph (a)(a) The term “proceeding” is intended to cover all official governmentalproceedings, which may include the pre-trial stage of a case.(b) It was understood that some countries may not cover cases where aperson has the right not to give evidence and an undue advantage is provided forthe exercise of that right.
