30 Travaux préparatoires: United Nations Convention against Transnational Organized Crime“(a) The <strong>of</strong>fences established in accordance with articles 3, 4, 4 ter and 17 bis<strong>of</strong> <strong>this</strong> Convention; and“(b) Serious <strong>of</strong>fences as defined in article 2 bis <strong>of</strong> <strong>this</strong> Convention;where the <strong>of</strong>fence is transnational in nature and involves an organized criminalgroup.“2. For the purpose <strong>of</strong> paragraph 1, an <strong>of</strong>fence is transnational in nature if:“(a) It is committed in more than one State; or“(b) It is committed in one State but a substantial part <strong>of</strong> its preparation, planning,direction or control takes place in a different State.“3. States Parties shall carry out their obligations under <strong>this</strong> Convention in amanner consistent with the principles <strong>of</strong> sovereign equality and territorial integrity <strong>of</strong>States and that <strong>of</strong> non-intervention in the domestic affairs <strong>of</strong> other States.“4. Nothing in <strong>this</strong> Convention entitles a State Party to undertake in the territory<strong>of</strong> another State the exercise <strong>of</strong> jurisdiction and performance <strong>of</strong> functions thatare reserved exclusively for the authorities <strong>of</strong> that other State by its domestic law.”Tenth session: 17-28 July 2000Notes by the Secretariat4. Delegations based their comments on the text <strong>of</strong> article 2 <strong>of</strong> the revised draft conventioncontained in <strong>document</strong> A/AC.254/4/Rev.9 and Corr.1, which was the same as thatcontained in <strong>document</strong> A/AC.254/4/Rev.8. At its tenth session, the Ad Hoc Committeeconsidered, finalized and approved article 2, as last amended. Paragraphs 3 and 4 weretransferred to a new separate article (article 4). Furthermore, it was decided that two additionalsubparagraphs should be placed in paragraph 2 on the basis <strong>of</strong> a proposal submittedby the United States. The text <strong>of</strong> that proposal was as follows.United States <strong>of</strong> America (A/AC.254/L.216)“Article 2“1. Amend paragraph 2 to read as follows:‘2. For the purpose <strong>of</strong> paragraph 1, an <strong>of</strong>fence is transnational in nature if:‘(a) [...]‘(b) [...]‘(c) It is committed in one State, but involves an organized criminal group thatoperates or has members in more than one State;‘(d) It is committed in one State but with effects or intended effects inanother State.’”
