Article 8 657Amendments to the proposals made by the Chairman <strong>of</strong> the Ad Hoc Committee at itseleventh session (A/AC.254/L.281)The Chairman <strong>of</strong> the Ad Hoc Committee proposed that article 9 should bereplaced with the following text:“Article 9“Marking <strong>of</strong> firearms“1. For the purpose <strong>of</strong> identifying and tracing firearms, States Parties shall:“(a) Require, at the time <strong>of</strong> manufacture <strong>of</strong> each firearm, appropriate uniquemarking providing the country or place <strong>of</strong> manufacture, the name <strong>of</strong> the manufacturerand the serial number;“(b) Require appropriate simple marking on each imported firearm, permittingidentification <strong>of</strong> the country <strong>of</strong> import and, where possible, the year <strong>of</strong> import andenabling the competent authorities <strong>of</strong> that country to trace the firearm, and a uniquemarking, if the firearm does not bear such a marking;“(c) The requirements <strong>of</strong> subparagraph (b) <strong>of</strong> <strong>this</strong> paragraph need not be appliedto temporary imports <strong>of</strong> firearms for verifiable lawful purposes;“(d) Ensure, at the time <strong>of</strong> transfer <strong>of</strong> a firearm from government stocks to permanentcivilian use, the appropriate unique marking permitting identification by allStates Parties <strong>of</strong> the transferring country.“2. States Parties shall encourage the firearms manufacturing industry to developmeasures against the removal or alteration <strong>of</strong> markings.”Notes by the Secretariat6. At its twelfth session, the Ad Hoc Committee considered, finalized and approvedarticle 9 <strong>of</strong> the draft protocol, as amended. It was placed together with articles 8, 10 to12, 14 and 15 <strong>of</strong> the draft protocol into one chapter entitled “Prevention”, on the basis <strong>of</strong>the proposals made by the Chairman <strong>of</strong> the Ad Hoc Committee at the eleventh session(see A/AC.254/4/Add.2/Rev.6, annex, para. 1). The last amendments are reflected in thefinal text <strong>of</strong> the protocol, as included in the report <strong>of</strong> the Ad Hoc Committee(A/55/383/Add.2, sect. III, draft resolution, annex), that was submitted to the GeneralAssembly for adoption pursuant to resolutions 54/126 <strong>of</strong> 17 December 1999 and 55/25 <strong>of</strong>15 November 2000.7. The representatives <strong>of</strong> Benin and Nigeria requested that the report <strong>of</strong> the Ad HocCommittee on its twelfth session should indicate their reservations on article 8, because<strong>of</strong> its vagueness regarding the marking <strong>of</strong> firearms. The representative <strong>of</strong> Azerbaijanrequested that the report <strong>of</strong> the Ad Hoc Committee on its twelfth session should indicatethat his Government had reserved its right to make reservations regarding article 8, paragraphs1 (b) and (c), <strong>of</strong> the draft protocol. The representative <strong>of</strong> the Syrian Arab Republicrequested that the report <strong>of</strong> the Ad Hoc Committee on its twelfth session should reflec<strong>this</strong> Government’s reservations regarding article 8 <strong>of</strong> the draft protocol. The representative<strong>of</strong> the Libyan Arab Jamahiriya requested that the report <strong>of</strong> the Ad Hoc Committee on itstwelfth session should reflect his Government’s reservations regarding article 8 <strong>of</strong> the draftprotocol. The representative <strong>of</strong> Haiti requested that the report <strong>of</strong> the Ad Hoc Committeeon its twelfth session should reflect her Government’s preference for a formulation <strong>of</strong>
