Article 23.AmendmentA. Negotiation textsRolling text (A/AC.254/4/Add.1/Rev.4)Sixth session: 6-17 December 1999“Article 20“Amendment“1. A State Party may propose an amendment and file it with the Secretary-General <strong>of</strong> the United Nations. The Secretary-General shall thereupon communicatethe proposed amendment to the States Parties, with a request that they indicate whetherthey favour a conference <strong>of</strong> States Parties for the purpose <strong>of</strong> considering and votingupon the proposals. In the event that, within four months from the date <strong>of</strong> such communication,at least one third <strong>of</strong> the States favour such a conference, the Secretary-General shall convene the conference under the auspices <strong>of</strong> the United Nations. Anyamendment adopted by a majority <strong>of</strong> States Parties present and voting at the conferenceshall be submitted to the General Assembly <strong>of</strong> the United Nations for approval.“2. An amendment adopted in accordance with paragraph 1 <strong>of</strong> the present articleshall enter into force when it has been approved by the General Assembly <strong>of</strong> theUnited Nations and accepted by a two-thirds majority <strong>of</strong> the States Parties.“3. When an amendment enters into force, it shall be binding on those StatesParties which have accepted it, other States Parties still being bound by the provisions<strong>of</strong> the present Protocol and any earlier amendments that they have accepted.”Notes by the Secretariat1. The text <strong>of</strong> article 20 is identical to the text <strong>of</strong> the corresponding provision <strong>of</strong> thedraft convention and is reproduced in accordance with a decision made by the Ad HocCommittee at its sixth session, without prejudice to its content, which was still under negotiation.Only necessary editorial changes were made to the text. The <strong>version</strong> <strong>of</strong> article 20 contained in <strong>document</strong> A/AC.254/4/Add.1/Rev.4remained unchanged in the intermediate draft <strong>of</strong> the protocol (A/AC.254/4/Add.1/Rev.5).567
