For the origin <strong>of</strong> the text <strong>of</strong> article 4, see article 3 <strong>of</strong> the convention and underarticle 1 <strong>of</strong> the convention, the proposal submitted by Germany in the context <strong>of</strong> thepreparatory stage <strong>of</strong> the negotiations before the establishment <strong>of</strong> the Ad Hoc Committee(A/AC.254/5). At the seventh session <strong>of</strong> the Ad Hoc Committee, Poland proposed thatparagraphs 3 and 4 <strong>of</strong> article 2 <strong>of</strong> the draft convention should be placed in a separate article(see article 3 <strong>of</strong> the convention, footnote 32). At the tenth session <strong>of</strong> the Ad HocCommittee, there was agreement that these paragraphs should form new article 2 ter, whichwas subsequently renumbered and became article 4 <strong>of</strong> the convention (see the final text<strong>of</strong> the convention, as included in the report <strong>of</strong> the Ad Hoc Committee (A/55/383, sect. IV,draft resolution, annex I), that was submitted to the General Assembly for adoption pursuantto resolution 54/126 <strong>of</strong> 17 December 1999).A. States Parties shall carry out their obligations under <strong>this</strong> Conventionin a manner consistent with the principles <strong>of</strong> sovereign equality and territorialintegrity <strong>of</strong> States and that <strong>of</strong> non-intervention in the domestic affairs <strong>of</strong> otherStates.2. Nothing in <strong>this</strong> Convention entitles a State Party to undertake in theterritory <strong>of</strong> another State the exercise <strong>of</strong> jurisdiction and performance <strong>of</strong> functionsthat are reserved exclusively for the authorities <strong>of</strong> that other State by its domesticlaw.37
