Article 30 259“[(d) States Parties shall also consider, in accordance with their domestic legislationand the provisions <strong>of</strong> <strong>this</strong> Convention, contributing to the aforementionedaccount a percentage <strong>of</strong> the money or <strong>of</strong> the corresponding value <strong>of</strong> illicit assets confiscatedin accordance with the provisions <strong>of</strong> <strong>this</strong> Convention];“(e) To encourage and persuade other States and financial institutions as appropriateto join them in efforts under <strong>this</strong> article, in particular by providing more trainingprogrammes and modern equipment to developing countries in order to assistthem in achieving the objectives <strong>of</strong> <strong>this</strong> Convention. 4“3. To the extent possible, these measures shall be without prejudice to existingforeign assistance commitments or to other financial cooperation arrangements atthe bilateral, regional or international level.“4. States Parties may conclude bilateral or multilateral agreements on materialand logistical assistance, taking into consideration the financial arrangements necessaryfor the means <strong>of</strong> international cooperation provided for by the presentConvention to be effective and for the prevention and control <strong>of</strong> transnational organizedcrime.”Notes by the Secretariat2. At its tenth session, the Ad Hoc Committee considered, finalized and approvedarticle 21 bis, as amended. It was decided that subparagraphs 2 (c) and (d) should bemerged and that the wording “may give special consideration” should be used in formersubparagraph 2 (d), as proposed by Brazil. The last amendments are reflected in the finaltext <strong>of</strong> the Convention, as included in the report <strong>of</strong> the Ad Hoc Committee (A/55/383,sect. IV, draft resolution, annex I), that was submitted to the General Assembly for adoptionpursuant to resolution 54/126 <strong>of</strong> 17 December 1999.B. States Parties shall take measures conducive to the optimal implementation<strong>of</strong> <strong>this</strong> Convention to the extent possible, through international cooperation,taking into account the negative effects <strong>of</strong> organized crime on society in general,in particular on sustainable development.2. States Parties shall make concrete efforts to the extent possible and incoordination with each other, as well as with international and regional organizations:(a) To enhance their cooperation at various levels with developing countries,with a view to strengthening the capacity <strong>of</strong> the latter to prevent and combattransnational organized crime;4Cameroon expressed the view that the issue covered by <strong>this</strong> paragraph should be dealt with in article 7 ter and referredto a proposal that Cameroon had made at the eighth session <strong>of</strong> the Ad Hoc Committee together with South Africa.
